AppleandAndroidDevices ThefollowingtermsapplywhenyouuseamobileapplicationobtainedfromeithertheAppleStoreorGooglePlay(eachan“AppDistributor”)toaccesstheSite: (1)thelicensegrantedtoyouforourmobileapplicationislimitedtoanon-transferablelicensetousetheapplicationonadevicethatutilizestheAppleiOSorAndroidoperatingsystems,asapplicable,andinaccordancewiththeusagerulessetforthintheapplicableAppDistributor’stermsofuse; (2)weareresponsibleforprovidinganymaintenanceandsupportserviceswithrespecttothemobileapplicationasspecifiedintheTermsofUseofthismobileapplicationlicensecontainedintheseTermsofUseorasotherwiserequiredunderapplicablelaw,andyouacknowledgethateachAppDistributorhasnoobligationwhatsoevertofurnishanymaintenanceandsupportserviceswithrespecttothemobileapplication; (3)intheeventofanyfailureofthemobileapplicationtoconformtoanyapplicablewarranty,youmaynotifytheapplicableAppDistributor,andtheAppDistributor,inaccordancewithitstermsandpolicies,mayrefundthepurchaseprice,ifany,paidforthemobileapplication,andtothemaximumextentpermittedbyapplicablelaw,theAppDistributorwillhavenootherwarrantyobligationwhatsoeverwithrespecttothemobileapplication; (4)yourepresentandwarrantthat(i)youarenotlocatedinacountrythatissubjecttoaU.S.governmentembargo,orthathasbeendesignatedbytheU.S.governmentasa“terroristsupporting”countryand(ii)youarenotlistedonanyU.S.governmentlistofprohibitedorrestrictedparties; (5)youmustcomplywithapplicablethird-partytermsofagreementwhenusingthemobileapplication,e.g.,ifyouhaveaVoIPapplication,thenyoumustnotbeinviolationoftheirwirelessdataserviceagreementwhenusingthemobileapplication; 6)youacknowledgeandagreethattheAppDistributorsarethird-partybeneficiariesoftheTermsofUseinthismobileapplicationlicensecontainedintheseTermsofUse,andthateachAppDistributorwillhavetheright(andwillbedeemedtohaveacceptedtheright)toenforcetheTermsofUseinthismobileapplicationlicensecontainedintheseTermsofUseagainstyouasathird-partybeneficiarythereof. SOCIALMEDIA AspartofthefunctionalityoftheSite,youmaylinkyouraccountwithonlineaccountsyouhavewiththird-partyserviceproviders(eachsuchaccount,a“Third-PartyAccount”)byeither:(1)providingyourThird-PartyAccountlogininformationthroughtheSite;or(2)allowingustoaccessyourThird-PartyAccount,asispermittedundertheapplicableTermsofUsethatgovernyouruseofeachThird-PartyAccount.
