Itisfurtherrecognizedthatpaymentcardcrimeinvolvespossessing,transferring,obtaining,orusinginanyotherway,aplasticorothercard,orotheraccessdevicewithanintenttoillegallytransferorattempttotransferfunds,goods,orservices. Wearedeeplyconcernedbythefactthatcriminalshavefoundinternationalorganizedpaymentcardcrimetobeanextremelyattractiveandrewardingenterpriseandthatadvancesintechnologyhavemadeiteasierforcriminalstooperatewithalmosttotalassurancesofimpunity.Thereexistsaconsiderablebodyofintelligencethatorganizedcriminalgroupsareresponsibleforthesignificantmonetarylossesthatarebeingincurredbythepaymentcardindustry.Internationalorganizedpaymentcardcrimeisaseriousproblemandtheeconomyofanycountrythatreliesontheuseofsuchcardsmusthaveaneffectivestructurefordeterringabuse. Webelievethatneitherlawenforcementauthoritiesnorthepaymentcardindustrycanworkinisolationindealingwiththismosttroublesomeproblem.Whatisrequiredisacollaborativeapproach--onethatinvolvestheconcertedandco-ordinatedinternationaleffortsofthelawenforcementandotherrelevantauthorities. Therefore,inordertoeffectivelycombatinternationalorganizedpaymentcardcrime,theG-8countriesendorsethefollowingprinciplesandactionplan.Itisurgedthatthissetofprinciplesandactionplanbeadoptedonaworldwidebasisinanattempttocombatthiswell-organizedandhighlysophisticatedcriminalactivity. PRINCIPLES: Weherebyendorsethefollowingprinciples,whichshouldbesupportedbyallcountries: Thereshouldbesufficientlawenforcementauthoritiesresourcesavailabletocombatinternationalorganizedpaymentcardcrime. Inordertoaddresstheglobalanduniversalproblemofinternationalorganizedpaymentcardcrime,certaincommonfeaturesamongnationallawsaredesirabletofacilitateaco-ordinatedinternationalapproachtotheproblem. Mutualassistanceregimesmustensurethetimelygatheringandexchangeofevidenceincasesinvolvinginternationalorganizedpaymentcardcrime. Effectivedataexchangesystemsrelatedtointernationalorganizedpaymentcardcrimearebothnecessaryanddesirable. Lawenforcementauthoritiesmust,totheextentpossible,remainabreastofchangingtechnologiesandinvestigativetechniquesrelatedtointernationalorganizedpaymentcardcrime. Co-operationbetweenthepaymentcardindustryandlawenforcementauthoritiesofmembercountriesisessential. Thereshouldbenoacceptablefinanciallossesassociatedwithinternationalorganizedpaymentcardcrime. ACTIONPLAN: Insupportoftheseprinciples,wearedirectingourofficialsto: Establishacentralpoint-of-contacttoensureatimelyandappropriateresponsetointernationalorganizedpaymentcardcrime. Reviewlegalstructurestoidentifythespecificcriminalactsrelatedtopaymentcardcrimethatshouldbeprohibitedandtotakeefforts,totheextentpossible,toensureuniformityofcriminalizationamongournationallawsandlegalsystemsandtoestablishcommonfeatures,includingtheoptimumlegaldefinitionsforcertainelementssuchas"paymentcard"and"computerpassword". Inordertopreventdomesticandinternationalmailservicesfrombeingabusedbycriminalsengagedininternationalorganizedpaymentcardcrime,ensure,totheextentpossible,thatnoshortcomingsexistinourlegalstructurethatwould,forexample,enablecriminalstousethemailstotrafficincounterfeitpaymentcardsorcomponents. Supporttheimplementationandcontinueddevelopmentofthe"UniversalClassificationSystemforCounterfeitPaymentCards",whichwasunanimouslyapprovedatthe65thInterpolGeneralAssemblySession,inNewDelhiinOctober,1997. Pursueaspecificcriminalanalysisprojectfocusingonspecificgeographicregionswherepaymentcardcrimetendstobemostprevalentoronspecificcriminalorganizationsthattendtobedeeplyentrenchedinrelatedcriminalactivity. Establishandmaintaineffectiveliaisonwithmanufacturersandsuppliersofmaterialandequipmentusedininternationalorganizedpaymentcardcrimeinanefforttoidentifytheirillegaluse. Encouragelawenforcementauthoritiesandthepaymentcardindustrytoprovidetrainingandeducationintheareaofpaymentcardsandinternationalorganizedpaymentcardcrime. Encouragethepaymentcardindustrytodevelopandimplementeffectivepaymentcardsecurityfeatures.Boththeretailerandthecardholdershouldrecognizetheirresponsibilitiestotakesecurityprecautions. Seektheco-operationoffinancialinstitutionsofmembercountriestoeffectivelypreventtheabuseofpaymentcardsby,interalia,terminatingpaymentcardaccountsandcreatinganearlywarningsystemtoalertvulnerableorganizationsaboutrelatedcriminalactivity. Promoteamulti-agencyandmulti-nationalapproachtoinvestigationsrelatedtointernationalorganizedpaymentcardcrime. EncouragetheuseofInterpolGreenNoticesandanyotheravailablemeanstodisruptcriminalactivitiesrelatedtointernationalorganizedpaymentcardcrime. Developandimplementanexchangeprogramforpoliceofficersinordertofacilitatethesharingofinformationandexperiencevis-a-visinvestigativetechniques,methods,andbestpracticesusedindealingwithinternationalorganizedpaymentcardcrime. Inordertoadvancethesegeneralprinciplesandco-operationbetweentheG-8countries,itisrecommendedthatregularmeetings,hostedbyanappropriateorganization,beattendedbyrepresentativesofthenominatedcentraloffices.
