"DomesticPassengerCarriage"(hereinafterreferredtoas"Carriage")means,irrespectiveofwhetherperformedforcompensationorgratuitously,acarriageinwhich,accordingtothecontractofcarriage,theplaceofdeparture,theplaceofdestinationandanyotherplace(s)oflandingaresituatedwhollywithintheterritoryoftheRepublicofKorea. 2. "Passenger"meansaperson,excludingthecrew,whoisbeingorwhoistobetransportedbyanaircraftundertheconsentoftheCarrier. 3. "Carriage",asasynonymoftransportation,meansairtransportationofPassengerorBaggageprovidedatacostorfreeorcharge. 4. "Carrier"meanstheaircarrierandincludesaircarrierthatissuesTicketsandaircarrierthattransportsPassengerorBaggagepursuanttothesaidTicketorthathasbeendelegatedtoexecuteotherservicesrelatedtotheaircarriageconcerned. 5. "GratuitousCarriage"meansaircarriageofPassengerorBaggageseparatelydesignatedbytheairlinetobetransportedatnocostwithoutpayingthePassengerfarestipulatedbytheairlineforgeneralaircarriage. 6. "Ticket"meansanelectronicdocumentorpaperdocument(includingItineraryReceipt),issuedbyEastarJetAirlines(hereinafterreferredtoas"Airline")orarepresentativedesignatedbytheAirline(hereinafterreferredtoas"Agent")forthecarriageofPassengersonthedomesticroute(s)inaccordancewiththeConditionsofCarriage,whichcontainsdetailsrecordedintheAirline’sdatabase. 7. "Reservation"meansPassengersreservingthecarriagescheduleandcompletingthepaymentoffaresandchargesforthecarriagesectionconcerned. 8. "ItineraryReceipt"meansadocumentordocumentsissuedbytheAirlinetoPassengersthatcontainsthePassenger'sname,flightinformationandnotices. 9. "RegularFare"meanstheundiscountedfarewhichCarrierappliestotheCarriageofPassenger. 10. "DiscountFare"meansPassengers'faresthattheAirlineflexiblyadjustsandoperatesaccordingtoReservationtimebasedonRegularFares. 11. "EventFare"isonethattheAirlineoperatesbasedonadditionalsaleconditioninspecialperiods. 12. "PackageFare"meansall-inclusivefareinwhichusagechargesfordesignatedseatingarrangementsisincludedinthePassengerfare. 13. "RoundTrip"meanstravelfromonepointtoanotherandreturntothepointoforigineitherbythesamerouteasthatusedfortheoutboundjourneyorbythedifferentroutefromthatusedfortheoutboundjourney,providedthatthesameone-wayfareappliestotheoutboundandinboundroutings. 14. "ClosingTimeofBoarding"meansthetimeassignedbytheAirlineforPassengertocompletetheboardingandreceiptofTicketandrefersto20minutesbeforetheexpecteddeparturetimeofflight. 15. "GroupPassengers"meansapartyoftenormorePassengerstravelingtogetheratthesametime,providedthattheReservationsofallthePassengershavebeenappliedforinadvanceatthesametime. 16. "Adult"meansaPassengerwhois13yearsofageoroveratthetimeofboarding. 17. "Child"meansaPassengerwhois2yearsofageoroverbutunder13yearsofageatthetimeofboarding. 18. "Infant"meansaPassengerwhoisunder2yearsofageatthetimeofboarding. 19. "Baggage"means,checkedorunchecked,suchARTICLES,effectsandotherpersonalpropertyofaPassengerasarecarriedinconnectionwiththePassenger'strip. 20. "CheckedBaggage"meansBaggagewhichaPassengerwishestobecheckedandforwhichtheAirlinehasissuedaBaggageClaimTagand/orexcessbaggageticket. 21. "Carry-onBaggage"meansBaggageotherthanCheckedBaggage. 22. "ExcessBaggage"meansBaggageinexcessofthefreebaggageallowanceofaPassengeraspermittedbytheAirline. 23. "BaggageClaimTag"meansadocumentissuedbytheAirlineforthecarriageofCheckedBaggageofthePassenger. 24. "SDR"meansSpecialDrawingRightstipulatedbytheInternationalMonetaryFund("IMF"). 25. "ItineraryChange"meanschangingthedeparturedateandtimeoftheaircarriageschedulethataPassengerhasreserved. ARTICLE2APPLICABILITYOFCONDITIONSOFCARRIAGE 1.ThisGeneralConditionsofCarriageapplytodomesticcarriageofPassengerandBaggagebyscheduledandcharterflight,andallservicesincidentaltheretoperformedbytheAirline.However,forthecharterflight,aseparatecharteragreementprevailsandwithregardstoitemsnotspecifiedinthecharteragreement,thisGeneralConditionsofCarriagewillbeapplied. 2.WhereaspecialagreementismadewithrespecttoacertainARTICLEintheseConditionsofCarriage,suchspecialagreementprecedesoversuchARTICLE. 3.TheCarriageofPassengerandBaggageissubjecttothisGeneralConditionsofCarriageandtheARTICLESandregulationsestablishedthereunderapplicabletotheairCarriagescheduleineffectonthedateaPassengermakesaReservation. 4.WithrespecttoGratuitousCarriage,theAirlineshallreservetherighttoexcludetheentireorpartialapplicationofthisGeneralConditionsofCarriage. 5.ThePassenger,byacceptingCarriagepursuanttoacharteragreementasprovidedinParagraph1above,isregardedashavingagreedtothisGeneralConditionsofCarriage. ARTICLE3CHANGEOFCONDITIONSOFCARRIAGEANDOTHERS 1. ThisGeneralConditionsofCarriageandprovisionsestablishedonthebasisofthisGeneralConditionsofCarriagemaybechangedwithoutpriornoticeintheeventthattheyarerequiredduetorelevantlaw,instructionsand/orrequirementsbythegovernmentauthorities,serviceimprovementandothers. 2. Section1ofthisArticleisnotapplicabletoPassengerswhohavemadeReservationspriortosuchamendment. 3. Exceptsection1ofthisArticle,priornoticeshouldbeprovidedfortheamendmentofthisGeneralConditionsofCarriageandtheprovisionsestablishedonthebasisofthisGeneralConditionsofCarriage,bypostingonthewebsiteandothermethods. ARTICLE4PUBLICATION Farestable,tableofcharges,theGeneralConditionsofCarriage,damagereliefplanandrelevantdocumentsrequiredforapplicationofdamagereliefshallbemadeavailabletoPassengersintheAirline’sbranchortheitssalesoffice. ARTICLE5PASSENGER'SCONSENT ItshallbeassumedthataPassengerhasrecognizedandconsentedtotheseConditionsofCarriageandtheARTICLESandregulationsestablishedthereunderbypurchasingadomesticTicketoftheAirline. ARTICLE6GOVERNINGLAWANDJURISDICTION 1.TheseConditionsofCarriageshallbeconstruedinaccordancewiththelawoftheRepublicofKorea,andtoanyothermatterthatisnotprovidedforhereinshallbegovernedbytheapplicablelawsoftheRepublicofKorea. 2.Thejurisdictionofanyaction,concerningtheCarriageperformedpursuanttotheseConditionsofCarriage,regardlessofnationalityofthecliamantortheexistenceofsuchclaim’sbasis,shallbesubjecttothecourtsoftheRepublicofKoreaandthelegalproceduresofsuchactionshallbeinaccordancewiththelawsoftheRepublicofKorea. ARTICLE7CHANGEANDCANCELLATIONOFFLIGHTSCHEDULE 1. TheAirlinemaychangeandreplacetheCarrieroraircraftwithoutpriornotice. 2. TheAirlineshallnotifythescheduledflighttimevalidatthepointwhenthePassengermakesaReservationandshallindicateitontheTicketuponitspurchase.ThescheduledflighttimemaybechangedevenaftertheTickethasbeenissuedandintheeventthePassengerhasprovidedthecontactdetails,theAirlineshallnotifysuchchanges.However,theAirlineshallnotbeliablefordamagesarisingoutoffailuretoreceivenotificationforthechangesduetothePassenger’scircumstancessuchasnotprovidingvalidcontactdetailstotheAirline. 3. TheAirlinemay,withoutnotice,changethescheduledflighttimeoforcanceltheflight,suspendtheflightorterminateanyflight,changetheplaceofdepartureordestination,makeemergencylandings,limitthenumberofPassengersonboard,unloadallorpartofloadedBaggage,becauseoflawsandregulations,governmentordersorrequest,malfunctionofequipmentandmaterial,adverseweather,labordisputessuchasstrikes,riots,civilcommotion,wars,anaturaldisaster,Carrier’scircumstances,connectiverelationofCarrier,unexpectedmaintenanceforsafeflight,labor,insufficientfuelorequipmentoranyothercircumstancesbeyondCarrier'scontrol.Insuchanevent,theAirlineshallarrangethepostponementofboardingintheorderoftheAirlineemployeeswhoarenotrequiredforflight,PassengerswithunconfirmedReservationsandPassengerswithconfirmedReservations. 4. TheAirlineshallnotbeliableforanydamagecausedasaresultofanyoneofreasonsfromSection1toSection3ofthisARTICLE,exceptforrefundsgivenontheapplicablefareorchargesfortheunusedportionofticketinaccordancewiththeprovisionsinSection3ofARTICLE22.However,intheeventtheCarriageisnotinperformanceordelayedduetointentionalornegligenceoftheAirline,theAirlineshallbeliableinaccordancewiththestandardspecifiedintherelevantConditionsandlaws. ARTICLE8INSTRUCTIONSBYAIRLINE’SEMPLOYEE PassengershallfollowtheinstructionordemandbytheAirline'semployeewithregardtoallactsrelatedtotheuseofaircraftsuchasemplaning,deplaningandanyotheractsorconductsattheairportandonboardtheaircraft,andtoloading,unloadingandcustodyofBaggage. CHAPTER2 PASSENGERS ARTICLE9ISSUANCEOFTICKET 1. TheAirlineshallissueaTicketand/orItineraryReceiptwhenPassengerhaspaidtheapplicablefareand/orcharges,orhascompliedwithallconditionsforcreditarrangementsestablishedbytheAirline. 2. PassengershallprovidetotheAirlineinformationsuchasname,gender,contactdetailsandothersrequiredforTicketissuance. ARTICLE10EFFECTIVENESSOFTICKET 1.Passengershallusehis/herTicketasinstructedorspecifiedtherein.AnyTicketshallbeinvalidifanyspecificationthereiniserasedoralteredbyotherthantheAirline’sagentorotherpersonauthorizedbytheAirlinetodoso,orallorpartthereofismutilated,unlesstheAirlinespeciallyadmitsitsvalidityfortheTicket. 2.TicketshallbevalidonlywhenPassenger'snameandotherCarriageconditionsindicatedontheTicketaresatisfied. 3.Ticketshallbenon-transferable. 4.TheAirlineshallnotbeliabletothePassengeroranyotherpartyforanydamagecausedasaresultofimproperorunauthorizeduseofaTicket,orfalseorincorrectinformationfurnishedbythePassengerinaTicket. 5.TheTicketissuedatafare,whichlimitsthecarriagetoaspecificperiod,shallbegoodforpassageonlyduringsuchspecificperiodandonthespecificportion(s)towhichthefareapplies. ARTICLE11PERIODOFTICKETVALIDITY Exceptasotherwisespecified,theperiodofTicketvalidityshallbetheclosingtimeofboardingofaspecificflight. ARTICLE12THETERMOFVALIDITYOFTHETICKETMAYNOTBEEXTENDED NotwithstandingrequestingextensionofTicketvaliditybeforetheexpirationdate,theTicketmaynotbeextended,andtheTicketmayberefundablewithin60daysfromexpirationdatestipulatedonARTICLE22.Cancellation/RefundofthespecialdiscountTicketsisnotallowed. ARTICLE13PASSENGERFARESANDCHARGES 1.PassengerfaresandchargesshallbethoseshownintheAirline'stariffs. 2.ThefaresandchargesshallapplyonlytoCarriagefromdeparturestationtoarrivalstationfortheCarriageschedulevalidonthedaythePassengerhadmadeReservationfor. 3.AdditionalpaymentisimposedbytheAirlineforadditionalservicesexceptairline’sdesignatedshippingserviceswithintheareasthatthePassengerisboundtobetransportedareprovided. 4.Whenthetotalfaresorchargesarelessthan100KRW,suchamountshallberounded. ARTICLE14APPLICABLEFARESANDCHARGES 1.TheapplicablefaresandchargesshallbethoseineffectatthetimeofReservationbythePassenger.(However,whenruleisamendedexceptionallybytheAirline,theapplicablefaresandchargesshallbethoseineffectatthetimeoftheruleamendment.) 2.Wherethefareorchargecollectedisnottheapplicableone,thedifference,ifany,shallberefundedtooradditionallycollectedfromthePassenger,whenbookingischangedbythePassenger. ARTICLE15ROUND-TRIPFARE Theapplicablefaresforaroundtripshallbecalculatedbyaddingeachfarefordeparture/arrivaltripfortheround-triporone-waytrip. ARTICLE16FREEOFCHARGEANDDISCOUNT 1. Aninfantaccompaniedbyanadultinthesamecompartmentshallbecarriedfreeofchargeprovidedthattheinfantdoesnotoccupyaseat. 2. AninfantoccupyingaseparateseatshallbedeemedasaChildandachilddiscountinwhich5,000KRWisdiscountedonlyfromtheapplicableRegularFare. 3. IndividualPassengermayreceivediscountfromanAdultRegularFareinaccordancewiththesubjectstipulatedseparatelybytheAirlineandwiththediscounttable.However,thePassengershallprovetheeligibilityfordiscounttotheAirlinebeforeboardingprocessanddiscountshallnotbeapplicableretroactivelyafterboardingprocessandafterboardinghasbeencompleted. 4. AsforGroupPassengers,faresandchargesmaybenegotiatedundertheconditionsstipulatedseparatelybytheAirlinedependingontheboardingarea,dateofdepartureandarrivaldateandtimeofdepartureandarrival. Article17FARESINTHEEVENTTHATAPERSONRESERVESTWOORMORESEATS 1. WhenthePassengerpurchasestwoormoreseatsatthesametimetousethemduetophysicalorotherreasons,chargesforthoseseatsshallbevalidfareforthoseseatssimultaneouslyatthedateofReservationandmayberegisteredattheReservationcenterandtheairportbranch. 2. ServicecommissionorusagefeeandotherchargesarisingfromthechangesimposedbytheAirlineappliestoeachseatthatthePassengerhasoccupiedandtheairportusagefeeappliestoeachPassenger. ARTICLE18TAX,USAGEFEEANDCHARGES InadditiontothefaresandchargesspecifiedbytheAirline,theapplicablefareand/orcharge,tax,usagefee,servicecommissionandotherincurredchargesimposedbythegovernmentauthority,airportoperatorandtheAirlineshallbecollectedfromthePassenger. ARTICLE19RESERVATIONSANDPRIORSEATSELECTION 1.RequestforseatreservationsisavailableduringtheperiodoftimespecifiedonthewebsiteandmobileoftheAirlineandsuchreservationisvalidonlyintheeventthattheTicketindicatesthattheseatisconfirmed.IntheeventthePassengerfailedtobuytheflightTicketuntilthetimespecifiedbytheAirlineafterthePassengerhasmadeaReservation,thatReservationshallbecancelledwithoutnoticeasitisdeemedthatthePassengerhasnointentiontoboard. 2.ReservationshallbeconfirmedonlywhenpaymenthasbeencompletedafterReservationandwhentheReservationnumberisassigned,ItineraryReceiptwillbeissuedsimultaneouslytothecustomer’se-mailorcanbecheckedviathewebsite. 3.PriorSeatselectionmaybesubjecttochangewithoutpriornoticeduetoinevitablecircumstancessuchascancellationofflight,delay,changeofaircraftmodelandotherreasonsandtheAirlineshallnotguaranteetheselectionofparticularseatoftheaircraft. 4.ReservationthroughtheAirline’swebsiteandReservationservicecentercanonlybemadeupto1hourbeforetheexpecteddeparturetimeandafterthat,Reservationcanbemadeonlythroughtheairportbranchuntiltheclosingtimeofboardingoftheexpectedflightofdeparture. 5.GroupReservationfor10ormorepersonsonthesameflightforthesameareaandsamedeparturetimeshallberegisteredandprocesseduponseparaterequest. 6.IntheeventthePassengerrequestsforReservationonwaitinglistduetofullReservationoftheexpectedflightofdeparture,itcanberegisteredonlyatthebranchofdepartureairportonlyfortheflightonthesaiddeparturedate. ARTICLE20ITINERARYCHANGEANDCHARGESFORCHANGE 1. IntheeventthatthePassengerwantstochangethedate,flights,routesanddestinationdescribedonTickets,suchchangescanbemadeonlythroughtheAirline’swebsiteupto1hourbeforethedepartureoftheexpectedflightandafterthat,changescanbemadeinaccordancewiththisGeneralConditionsofCarriageandregulationsspecifiedhereunderontheconditionthatseatsareavailable. 2. ThePassengername,areaordestinationcannotbechangedunlesssuchchangesaremadeuponre-purchaseaftercancellation. 3. IntheeventofchangingtheconfirmeditineraryduetothePassenger’scircumstance,chargesforItineraryChangespecifiedseparatelybytheAirlineshallbecollected. A.IntheeventthatthenumberofPassengersarebetweenoneormoreandthirtyorless,additionalfeesof2,000KRWarechargedforItineraryChangeinadditiontothecommissionfortheItineraryChangeintheeventthatItineraryChangeisrequiredthroughtheAirline’sairportbranchesand/orreservationservicecenter. B.ChargesforItineraryChangeshallbeexemptedonlyfor24hoursfromthepurchasetime,intheeventthePassengerhasreservedandpurchasedseatssimultaneously.IntheeventtheReservationandpurchasetimediffer,chargesforItineraryChangeshallbeexemptedonlyfor24hoursafterReservationhasbeenmade. C.ChargesforItineraryChangeshallbeexemptedevenwhenthePassengerchangestheitinerarytwiceormorewithinthedateofReservationthroughthereservationservicecenterwithregardstothesamearea. D.WhenthePassengerisunabletousetheflightattheairportonthedeparturedateandusesanotherflightonthesameday,he/sheshallbeexemptedfromthecancellationcommissionbutshallpaythefaredifferencesifanyexceptthecaseoftheEventFare. E.ForGroupPassengerswith31ormorepersons,chargesforItineraryChangespecifiedseparatelybytheAirlineshallbecollectedwhenchangingtheitinerary. 4.IntheeventthattheAirlinecancelsaflightduetoreasonsotherthanthecircumstanceofthePassenger,failstoprovidethepreviouslyconfirmedseatofthePassenger,omitsascheduledstopatthepointofthePassenger'sdeparture,stopoverordestinationasspecifiedintheTicketorfailstooperatetheflightnormallyinaccordancewiththeschedule,theAirlineshalleither: A.CarrythePassengerandBaggagetothepointofstopoverordestinationonanotheraircraftorothermeansoftransportationonwhichspaceisavailable,withoutadditionalcollection, B.Changethedateoftravel,flightorroutinguponrequestfromthePassenger;or C.Refundforthefareand/orcharge,ifany,inaccordancewiththeprovisionsinSection3ofARTICLE22andotherrelatedARTICLEsandregulations. 5.RoutesandnamechangesofspecificflightTicketsareappliedbythestipulatedprovisionoftheAirline. ARTICLE21ADVANCEDRESERVATIONCANCELLATIONANDCANCELLATIONCHARGES 1.PassengerswhodecidenottoboardtheflightduetothePassenger’spersonalcircumstancesshallnotifytheAirline’sairportofficeorthesalesofficeonthecancellationofconfirmationbeforetheclosingtimeofboardingoftheflightconcerned. 2.ApenaltyfordishonoringaReservationspecifiedseparatelybytheAirlineshallbecollectedfromPassengerswhodonotboardtheconfirmedflightwithoutgivingcancellationnoticeforthescheduledflightpriortotheclosingtimeofboarding. 3.ForindividualPassengerorthirtyormorePassengers,ifarequestforcancellationhasbeenmadethroughtheAirline'sairportbranchorreservationservicecenter,2,000KRWshallbechargedinadditiontothecancellationcommissionconcerned. 4.ChargesforItineraryChangeshallbeexemptedfor24hoursafterpurchaseintheeventthePassengerhasreservedandpurchasedseatssimultaneouslyandintheeventtheReservationandpurchasetimediffer,chargesforItineraryChangeshallbeexemptedfor24hoursafterReservationhasbeenmade. 5.AsforTicketswithregulationspecifiedseparatelybytheAirlinewithregardstothecancellationofthePassenger’sReservation,itshallbeapplicable. 6.ForGroupPassengers,incasethattheirnumberis31ormore,chargesforItineraryChangespecifiedseparatelybytheAirlineshallbecollectedwhenchangingtheitinerary. ARTICLE22REFUND 1.RefundforanunusedTicketorportionthereofshallbemadeinaccordancewiththefollowingprovisions. A.Theapplicationforrefundshallbemadewithin60daysfromscheduleddeparturedateandthecancellationpenaltybasedontheItineraryCancellationpointshallbedeductedfromtherefundamount.However,fareforthespecialdiscountTicketsisnotrefundable. B.Thepersonrequestingrefundshalldeliverhis/herintentionforrefundandmakearequesttotheAirline'swebsite,airportbranch,reservationservicecenterortheagentwheretheTicketwaspurchased. C.RefundwillbemadetothepersonnamedontheTicketoranyotherpersonwhomAirlinespeciallyadmitstobeentitledtotherefund.However,forTicketsissuedwithacreditcard,refundwillbemadebycancellingthesalesofthecreditcardconcerned. D.RefundisvalidwhenitismadeinaccordancewiththisGeneralConditionstoapersonnamedordesignatedinthedocumentsacknowledgedbythecountrysuchasID,passportordriverlicenseetc.presentedforrefundafteraself-verificationhasbeenconductedandAirlineshallnotbeliableforanotherrefundtotherightfulpersonagaininsuchcases. 2.RefundsduetotheCustomer’sCircumstances TheamountofrefundduetotheCustomer’sCircumstancesshallbeamountoffareexceptrefundchargespaidbythePassengerinthecaseofentirelyunusedTicketaccordingtoARTICLE21(AdvancedReservationCancellationandCancellationCharges),orthedifference,ifany,betweenthefullamountoffarepaidandtheamountoffareandcancellationcommissionapplicableincaseofpartiallyusedTicket.TicketspurchasedwithEventFareisnotrefundable. 3. RefundsDuetotheOtherReasonThanCustomer’sCircumstances RefundduetotheotherreasonthanCustomer’sCircumstanceswillbemadeeitherwhentheAirlinecancelstheflight,failstoprovidepreviouslyconfirmedseatsforthePassenger,causesamisconnectionofflight,delaysorpostponesthescheduleddeparturetimeoftheflightoromitsascheduledstopasshowninthePassenger'sTicket,orwhenarefundisnecessaryunderthecircumstancesassetforthinARTICLE7(ChangeandCancellationofFlightSchedule)andARTICLE25(RefusalandLimitationsofCarriage,etc.).However,withregardstodamagesufferedbythecustomerduetoreasonsnotspecifiedabove,compensationshallbemadeasspecifiedbyConsumerDisputeResolutionStandardofficiallyannouncedbytheFairTradeCommission. A.Thefullamountoffareand/orchargepaidbythePassengershallberefundedforentirelyunusedTicket. B.IntheeventthattheflightisinterruptedaftercommencementoftravelatthepointofthePassenger'sdeparture,stopoverordestinationasspecifiedintheTicket,theamountoffareand/orchargesineffectonthedateofflightbetweentheinterruptionpointandthepointofstopoverordestinationshallberefunded. ARTICLE23PASSENGER'SARRIVALATAIRPORT 1.PassengermustcompletetheboardingprocessoftheAirlineandrelevantagencywellinadvanceofthescheduleddeparturetimeoftheflight.TheAirlinereservestherighttorefusetocarrythePassengerwhofailstocompletethecheckinprocedures(seatassignmentandbaggagecheckin)atleast20minutesbeforethescheduleddeparturetimeofflight. 2.InnocaseshalltheAirlinedelaythedeparturetimeoftheparticularflighttowaitforthePassengerwhofailstoarriveintimetocompletetheproceduresorwhoisnottakeonboard,andtheAirlineshallnotbeliabletothePassengerexceptforarefund,ifany,inaccordancewiththeprovisionsinSection2ofARTICLE22(RefundsduetotheCustomer’sCircumstances). ARTICLE24UNAUTHORIZEDBOARDING AnyoftheconductsenumeratedhereundershallbeconsideredasunauthorizedboardingandthePassengershallbechargedtwiceoftheregularAdultFareapplicabletotheportionoftheinvolvedpassage. 1.InthecasethatthePassengerboardsontheflightwithaninvalidorforgedTicket,aTicketissuedinthenameofsomeoneotherthanthePassenger,orotherPassenger'slostTicket. 2.IncasethatthePassengerboardsontheflightwithaspecialDiscountFarebyfalselyrepresentinghim/herselfastheeligibleforaspecialfareestablishedbytheAirline. ARTICLE25REFUSALANDLIMITATIONSOFCARRIAGE,ETC. Anyoftheconductsenumeratedhereundershallbeconsideredasboardingunauthorizedandthepassengershallbechargedtwicetheregularadultfareapplicabletotheportionoftheinvolvedpassage. 1.RighttoRefuseofCarriage A.TheAirline,tocomplywiththelaworuponrequestofgovernmentauthorities,mayrefusetocarrythePassengerorhis/herBaggage. B.TheAirlinemayrefuseCarriageordeplanethePassengerorhis/herBaggageenroute,ifoneormoreofthefollowinghaveoccurredoritisreasonablybelievedthatitwouldoccur: (1)ThePassengerhasfailedtofollowtheinstructionsorrequirementsbythegovernmentauthoritiesortheAirlinewithrespecttosafetyorsecurity; (2)Suchactionisnecessaryinordertocomplywithanyapplicablegovernmentlaws,regulations,ororders; (3)TheCarriageofthePassengerorBaggagemayendangeroraffectthesafety,health,ormateriallyaffectthecomfortofotherPassengerorcrew; (4)ThementalorphysicalstateofthePassenger,includingtheimpairmentfromalcoholordrugs,maybehazardoustoorendangerhimself/herself,otherPassengers,crew,orproperty. (5)Thereisaconcernforapersonengagedinthreateningacts,aggressiveacts,violentlanguageorinsultingandothersduringboardingprocesssuchasticketing,capableofcausingharmtothesafetyofotherPassengersandtothesafeflightofaircraft. (6)ThePassengerhascommittedmisconduct(commotionunderinfluenceofalcohol,loudsinging,sexualharassment,inflictingharmonemployees,unreasonabledemandsetc.)onapreviousflight,andtheAirlinehasreasontobelievethatsuchconductmayberepeated. (7)ThePassengerhasrefusedtoshowhis/heridentificationuponrequestbytheAirlineoritsdesignatedagentinordertocheckifhe/sheisthepersonnamedonhis/herTicket,orhe/shefailstoidentifybyhimself/herself. (8)ThePassengerhasrefusedtosubmittoasecuritycheckforhim/herorproperty. (9)ThePassengerpresentsaTicketthathasbeenacquiredunlawfully,hasbeenpurchasedfromanentityotherthantheAirlineoritsauthorizedagent,orhasbeenreportedasbeinglostorstolen,orisacounterfeit. (10)ItisdeemedthatthePassengercannottravelalonewithoutthehelpofthethirdparty. C.IntheeventthatthepermissibleloadoftheaircrafthasreducedduetoinevitablecircumstancesthattheAirlinecouldnotforeseeinadvance,theAirlinemaydesignatetheminimumPassengersorgoodstosatisfythepermissibleloadoftheaircraft.However,insuchcase,theAirlineshalldeterminewhowillbethepersonsubjecttopostponementofboardingintheorderoftheAirlineemployeeswhoarenotrequiredforflight,PassengerswithunconfirmedReservationsandPassengerswithconfirmedReservations. D.IntheeventthereisnotenoughpermissibleloadduetoexcessivesalesorthenegligenceoftheAirline,theAirlinemayencouragethePassengerstopostponetheflightvoluntarily.NotwithstandingtheAirline’sefforttominimizenon-voluntarypostponementofflight,intheeventthatnon-voluntarypostponementofflighthasoccurredtothePassengerduetolackofPassenger’svoluntarypostponement,thosewhosubjecttoflightpostponementshallbeassignedintheorderoftheAirlineemployeeswhoarenotrequiredforflight,thePassengerswithunconfirmedReservationsandthePassengerswithconfirmedReservations.However,insuchanevent,thePassengersaccompaniedbychildren,vulnerabletransportationuserssuchasthedisabledandpregnantwomenshallnotbesubjectofthepostponement.ThePassengerswhoseflighthasbeenpostponedinvoluntarilyshallbecompensatedinaccordancewiththeCarriagenon-fulfillmentclauseoftheConsumerDisputeResolutionStandard. E.ThePassengerwhoisrefusedCarriageordisembarkedenrouteforreasonsfromParagraphs"(A)"to"(C)"aboveshallbehandledinaccordancewiththeprovisionsinSection4ofARTICLE7herein. 2.ConditionalAcceptanceofCarriage A.TheAirlinemaycarry,accordingtorelatedconditionsandregulations,thePassengerwhosestatus,age,ormentalorphysicalconditionmayinvolveanyhazardorrisktohimself/herselfwhensuchPassengerand/orhis/herguardianagreedoracceptedthattheAirlineisnotliableforanyinjury,illness,disabilityoranyaggravationorconsequencescausedbysuchcondition,ageormentalorphysicalconditionofthePassenger. B.AcceptanceforCarriageofunaccompaniedminor,disabledpersons,pregnantwomen,personswithillnessorotherpersonsrequiringspecialassistanceissubjecttotheconditioninwhichinformationrequestedbytheAirlineisprovidedinadvancetotheAirlinewithregardstothenecessarymeasuresandCarriagemayberefusedwithouttheprovisionofinformationtotheAirlineinadvance. C.UponpurchasingtheTicket,thePassengermustcontacttheairportbranchorreservationservicecentertodeclaretravelofunaccompaniedminor,disability,pregnancy,illnessandothersandtorequestfornecessaryitemsandtheAirlineshallacceptCarriageafterdeterminingthepossibilityofCarriageofthePassengerconcerned.OrtheAirlinemaydeterminethepossibilityofCarriagethroughinformationondisabled,pregnantwomen,personswithillnessandothersprovidedbythePassengerinadvance.IntheeventthatthePassengerrequestsforservicesthatcannotbeprovidedduetotherestrictionsoftheAirline’sbasicmaterialandequipmentandothers,Carriagemayberefused. D.ThefollowingtypesofPassengersclassifiedasCarriageofPassengerthatrequiresspecialassistancefromtheAirlineneedtoprovideinformationinadvance. (1) Disabilityinexternalphysicalfunctions:Visualimpairment,hearingimpairment,physicaldisability,brainlesions (2) Disabilityininternalorgans:Kidneydisorder,heartdisorder,liverdisorder,respiratorydisorder,epilepticdisorder (3) Mentaldisability:Intellectualdisability,autisticdisorder,mentaldisorder,emotionalandbehavioraldisorder (4) Otherhealthdisorders E.PassengershallnotifythedisabilityandrequiredspecialassistancetotheAirlineandCarriagemayberefusedintheeventthatsuchdisabilityandrequiredspecialassistancehavenotbeennotified.IntheeventithasbeenproventhattheAirlinehasnotcontributedtothelosseswithregardstodamageincurredtotheaircraftandtheinjuryanddeathofotherPassengersorthePassengerarisingfromnotnotifying,theresponsibilityoftheAirlineshallbeexemptedorreducedinaccordancewithSection1andSection3ofARTICLE39. 3.ConductsintheAircraft A.IfthePassengerconductshimself/herselfaboardtheaircraftoneofthefollowing,theAirlinemaytakesuchmeasuresasitdeemsnecessarytopreventcontinuationofsuchconduct,includingrestraint.SuchPassengermaybedisembarkedandrefusedonwardcarriageatanypoint,andmaybesubjecttocivilorcriminallawsuitforoffencescommittedonboardtheaircraft. (1)Behaviorbroughtaboutbreachofpeaceincludingusingviolentlanguageandsingingloudly (2)ThePassengerfailstocomplywithanyinstructionsorrequirementsofthecrewwithregardstoactsintheaircraft(including,butnotlimitedto,behaviorswithrespecttosmoking,drinking,drugconsumption,commotion) (3)Behaviorcausingsexualhumiliation (4)IntheeventthatthePassengertriestoenteracabinwithoutpermission (5)ThePassengerendangerstheaircraftoranypersonorpropertyonboard (6)ThePassengerbehavesinamannerwhichcausesdiscomfort,inconvenience,damageorinjurytootherPassengersorthecrew B.ThePassengershallbeliableforanydamagesincurredasresultofanyoftheconductsreferredtoinParagraphAabove. 4.ElectronicDevices Forsafetyreasons,theAirlinemayforbidorlimitoperationaboardtheaircraftofelectronicequipment,including,butnotlimitedto,cellularphones,portabletelevisions,laptopcomputers,portablerecorders,portableradios,CDplayers,electronicgamesortransmittingdevicesincludingradiocontrolledtoysandwalkie-talkies. CHAPTER3 BAGGAGE ARTICLE26CHECKEDANDUNCHECKEDBAGGAGE TheAirlinewillacceptandcarryBaggageinaccordancewiththeprovisionsoftheseConditionsofCarriage,whenBaggageispresentedtoairportofficeoftheAirlinetogetherwithavalidTicket. ARTICLE27TRANSPORTATIONOFBAGGAGE ItisageneralruleoftheAirlinethatCheckedBaggagewillbecarriedonthesameflightasthePassenger;howeverwhenAirlinehasinevitablereasonstocomplywiththegeneralrule,suchasthemaximumpermissibleweightorAirline’scircumstance,BaggagewillbecarriedonanyotherflightinwhichtheCheckedBaggagecanbeloaded. ARTICLE28INSPECTIONOFBAGGAGE TheAirlinemayinspectthecontentsofthePassenger'sBaggageinthepresenceofthePassengerorathirdpartydesignatedbythePassenger,wheneveritisregardedasnecessarytodosoforthepurposeofsecurityoranyotherreason. ARTICLE29REFUSALORRESTRICTIONTOTRANSPORT 1. RefusalofBaggageCarriage UnlessotherwisepermittedbytheAirline,thearticleslistedbelowshallnotbeacceptedforCarriageasthePassenger'sBaggageandtheAirlinemayrefusetotransporttheCarriage. A.AnyarticleinwhichtheloadingonaircraftandCarriageis"prohibited"bylawsorrequestofgovernmentinstitution. B.AnyarticledesignatedoracknowledgedbyICAO,IATA,theAirlineandothersasarticleswithconcernforcausingdangerorencumbrancetothoseonboardorotherpropertyonaircraft. C.Anyfragileorimproperlypackedarticle. D.Currency,banknotes,securities,stamps,jewelry,artworks,curios,samples,documentsorotherhigh-valuedarticlesshallnotbeacceptedforCarriageasCheckedBaggage. E.Thewheelchairusedbyadisabledpersonhim/herselfshallbecarriedasaCheckedBaggage.(However,theCarriageofelectronicwheelchairmaybealloweddependingontypesofbatteryusedunderIATADangerousGoodsRegulation.) ARTICLE30FREEBAGGAGEALLOWANCE 1.PassengerswhohavepaidthefullamountofEconomyclassfareshallbegrantedtheCheckedBaggageallowanceof15kg(33pounds)atnocost.ExcessBaggagechargeisimposedonExcessBaggage.(However,thePassengerswhopurchaseTicketswithEventFareshallnotbesubjecttofreecheckedinBaggageandwhencheckinginBaggage,mustpaytheamountspecifiedbytheAirline.) 2.PassengermaycarryoneBaggageinthecabinatnocostsuitableforplacinginclosedoverheadrackorunderPassengerseatonthePassenger'scustody,withmaximumthreedimensionsofnotmorethan115cm(50*30*35cm)andweightofnotmorethan7kg(15pounds). 3.Baggageexceedingsuchmaximumdimensionsand/orweightwillbecarriedasCheckedBaggage.IfthePassengerrejectsthis,CarriermayrefusetocarrythatPassengerorhis/herBaggage. 4.TheprovisionsinSection1andSection2ofthisArticleandARTICLE31willalsoapplytoInfantorChildpayingchildfare. 5.WithregardstoInfantspecifiedinSection1ofARTICLE16(Freeofchargeanddiscount)ofthisGeneralConditionsofCarriage,thisarticleandARTICLE31(CarriedinCabin)shallnotbeapplicable.However,onefullyfoldablestroller/push-chairorinfant'scarryingbasketorinfant'scarseatmaybecarriedasCheckedBaggage. ARTICLE31CARRIEDINCABIN 1.InadditiontothePassenger'sfreebaggageallowancespecifiedinSection3ofARTICLE30(Freebaggageallowance),thebelongingslistedbelowmaybecarriedincabinbythePassengerwhenretainedinthePassenger'scustody. A.Onelaptopcomputer B.Onebriefcase C.Onehandbagorcosmeticbag D.Oneovercoatorblanketorwrap E.Infant'sfoodforconsumptionduringtheflight F.Onepairofcrutches,bracesandtheprostheticdevicesforthephysicallyhandicappedPassenger'suse G.Onesmallcameraorcamcorder 2.AnyotherbelongingswhicharenotstipulatedinSection1ofthisArticleshallnotbecarriedincabin,unlessotherwisepermittedbytheapplicablelaws,governmentordersortheAirline'sARTICLEsandregulations. ARTICLE32EXCESSBAGGAGECHARGES 1.AnyweightofPassenger'sBaggageinexcessoftheallowableweightlimitasprovidedinARTICLE30(Freebaggageallowance)shallbesubjecttoExcessBaggagechargeestablishedbytheAirline.TheAirlineshallissueareceiptandBaggageClaimTag. 2.WhendeterminingtotalweightofExcessBaggage,aweightof0.5kilogramormoreshallberoundup1kilogram,andaweightlessthan0.5kilogramshallnotbecounted. ARTICLE33REFUNDOFEXCESSBAGGAGECHARGES 1.IntheeventthePassengercancelstheunusedflightaswellastheCarriageofhis/herCheckedBaggageuntil20minutesbeforethedeparturetimeoftheflight,thefullamountofExcessBaggagechargepaidwillberefunded. 2.IfthePassengercancelstheCarriageofBaggageafterthetimelimitprovidedaboveorrequestsdeliveryofBaggageatanintermediatepoint,theAirlineshallbeundernoobligationtorefundtheExcessBaggagechargepaid,exceptwheretheAirlinefailstofulfillpartortheentirecontractofCarriagewiththePassenger. ARTICLE34EXCESSVALUECHARGE EastarJetshallnotprovideExcessValueChargeservice.ThePassengerswhorequestthisservicemayberefusedtobecarried. ARTICLE35CARRIAGEOFSPECIFICANIMALS 1.InadditiontothePassenger'sfreebaggageallowance,aseeing-eyedogaccompaniedbyablindpassengerorhearingdogaccompaniedbyadeafpassengermaybecarriedincabinfreeofcharge,subjecttofollowingconditions. A.SuchanimalmustbeaccompaniedbythePassengerandmustnotoccupyaseat. B.Suchanimalmustnotcausediscomfort,inconvenienceorhazardtootherPassengers. C.TheAirlineshallnotbeliableforthedeath,woundingorillnessofsuchanimalsduringtheflightunlesssuchdamageswascausedbythewillfulmisconductornegligenceoftheAirline. D.ThePassengeraccompanyingsuchanimalshallbewhollyliableforthedamagestootherPassengersorpropertycausedbytheanimal. 2.PetsaccompaniedbythePassengerwillonlybecarriedasCarry-onBaggage,subjecttothefollowingconditions. A.Pet(s)acceptedforCarriageshallbelimitedtosuchdomesticanimalsasdogs,catsandbirds. B.ThepetmustberetainedinaseparatecontaineratthetimeofdeliveryforCarriageandduringtheflight. C.TheAirlineshallnotbeliableforthedeath,woundingorillnessofsuchanimals;unlessitisprovedthatthedamagewascausedbythewillfulmisconductofnegligenceoftheAirline. D.ThePassengeriswhollyresponsibleforanydamagecausedbyhis/heranimalstootherPassengersandproperty. E.Thetotalweightofpetanditscontainershallbesubjecttoseparatecharges,irrespectiveofthePassenger'sfreebaggageallowancewithregardstopetwhoseCarriagehasbeenacceptedinaccordancewiththisARTICLE. F.ThePassengerrequestingfortheCarriageofanimalhastonotifytheAirlinesinadvanceontherequireditemsandifnot,theCarriagemayberefused. ARTICLE36DELIVERYOFCHECKEDBAGGAGE 1.CheckedBaggageshallbedeliveredtoapersonwhoholdstheBaggageClaimTagonlywhenthetag,issuedbytheAirline,isreturnedtotheAirline. 2.TheBaggagewillbedeliveredatthepointofdestinationspecifiedintheBaggageClaimTag.However,uponrequestfromthepersonwhoholdstheBaggageClaimTag,CarriermaydeliverCheckedBaggageattheplaceofdepartureoratanintermediatestoppingplace,iftimeandothercircumstancespermittodoso. 3.TheAirlineshallnotbeobligatedtoascertainwhethertheholderofBaggageClaimTagisthepersonwhoisentitledtothedeliveryofsuchBaggage,andshallnotbeliableforanydamagecausedtothePassengerasomissionofsuchascertainment. 4.AtthetimeofBaggagedeliverybytheAirlineinaccordancewiththisArticle,theBaggageisdeemedtobedeliveredproperlyingoodconditioninaccordancewiththecarriagecontract,unlessthepersonwhoholdstheBaggageClaimTagobjectstothedeliveryinwritingunderproperprocess. ARTICLE37LOSTBAGGAGECLAIMTAG IntheeventthatthePassengerhaslosttheBaggageClaimTag,theAirlinemaydelivertheconcernedBaggageonlyontheconditionthatsuchpersonisacknowledgedastherightfulpersontheretoandthatsuchpersonshallfurnishadequatesecuritytoindemnifytheAirlineandbeliableforanydamageincurredbytheAirlinewhichmayariseoutofsuchdelivery. ARTICLE38DISPOSALOFUNDELIVEREDBAGGAGE IntheeventthatBaggageisunclaimedwithinoneweekafteritsarrivalatthedestination,theAirlinemaydisposeoftheBaggageastheAirlineconsiderstobeappropriate.Fishorotherperishablesmaybedisposedofifunclaimedwithin48hoursafteritsarrivalatthedestination. CHAPTER4 LIABILITYOFAIRLINE ARTICLE39LIABILITYOFAIRLINE 1.TheAirlineshallbeliableforthedeathorinjuryofthePassenger,onlywhentheaccidentthatcausesthedamagetookplaceonboardtheaircraftorinthecourseofoperationforembarkingordisembarking.However,theresponsibilityoftheAirlinemaybeexemptedorreducedintheeventthatCommercialActArticle898isapplied. 2.TheAirline’sliabilityforcompensationcannotbeexemptedorrestrictedupto128,821SDRperPassengerfordamagesoftheSection1ofthisArticle. 3.Withregardstodamagesthatexceed128,821SDRperPassengerfordamagesofSection1,theAirlinemaynotbeliableforcompensationifoneofthefollowingitemsisproven. A.ThatthedamagehasnotbeencausedbythenegligenceoftheAirlineoritsuseroragentorbyotherillegalactoromission;or B.Thatthedamagewassolelycausedbyathirdparty’snegligenceorotherillegalactoromission. 4.WithregardstodamagearisingfromthelossordamageofCheckedBaggage,theAirlineshallbeliableonlywhenthefactthatthecauseofthesaiddamagesosustainedtookplaceduringtheperiodsuchCheckedBaggagewasonflightorunderthechargeoftheAirline.However,intheeventthesaiddamagehasbeencausedbytheuniqueflaw,specialqualitiesorhiddendefectoftheCheckedBaggage,Airlineshallnotbeliablewithinthesaidrange. 5.WithregardstodamagearisingfromthelossordamageofuncheckedBaggage,theAirlineshallbeliableonlyintheeventthesaiddamagehasbeencausedbyoneselfortheintentionalnegligenceofitsuseroragent.AssistanceprovidedbytheAirlineemployeetothePassengerintheprocessofhandlingtheuncheckedBaggageisserviceforthePassengerincourtesy. 6.TheAirlineshallbeliablefordamagescausedbythedelayofBaggagedelivery.However,thesaidliabilityshallbeexemptedifitisproventhattheAirlineitselfanditsuserandAgenttookallmeasuresdemandedreasonablytopreventdamageorthatitwasimpossibletotakesuchmeasures. 7.TheAirlineshallnotbeliablefordamageswithregardstothePassenger’sBaggageinwhichthecontentofthePassenger’sBaggagehascontributedtothedamage.However,incaseotherPassenger’sBaggageortheAirline’spropertyhasbeendamagedduetothegoodsofthePassenger,theconcernedPassengershallcompensatetheAirlineforallthelossesandexpensesincurredtotheAirline. 8.TheAirline’scompensationfordamagefollowingSection4orSection6shallnotexceedthelimitspecifiedintheCommercialAct(1,288SDRperPassenger)andthemaximumamountoftheAirline’scompensationshallnotexceedtheactualpriceoftheBaggageconcernedinanycasewhatsoever. 9.IntheeventthatithasbeenproventhatdamagehasbeencausedintentionallybytheAirlineoritsuserorAgentorbyrecklessactoromissionwhileithasbeenacknowledgedthattheremayberiskofloss,damageordelayofBaggage,Section8shallnotapplicable. 10.TheAirlineshallnotbeliablefordirectorindirectdamagesthathavebeencausedbycomplyingwiththelaw,governmentregulation,orderorrequirement,reasonsuncontrollablebytheAirlineorPassengerswhohavenotcompliedwiththelaw. 11.TheplaceofpaymentforcompensationinrelationtotheAirline’sresponsibilityshallbetheheadofficeofEastarJetAirlinesCo.,LtdlocatedinSeoul,theRepublicofKorea. 12.TheexchangerateofSDRshallbebasedonthevalidexchangerateonthefinalcourtrulingdateandasforthecompensationdeterminedinawayotherthanthelitigation,theexchangerateofthedaytheagreementhasbeenreachedshallbeapplied. ARTICLE40NOTIFICATIONRELATEDTOPARTIALLOSSORDAMAGEOFCHECKEDBAGGAGE 1.WhenthePassengerdiscoverspartiallossordamageofCheckedBaggage,itssummarizeddetailsshallbenotifiedtotheAirlineinwritingorviaelectronicdocumentimmediatelyafterreceivingtheCheckedBaggage.However,intheeventthesaidlossordamagewasunabletobediscoveredimmediately,thenoticeshallbemadewithin7daysaftertheCheckedBaggagehasbeenreceived. 2.IntheeventtheCheckedBaggagehasbeendelayed,thePassengerhastoraiseanobjectionwithin21daysfromthedaytheCheckedBaggagecanbedisposedof. 3.IntheeventthatthereisnonotificationstipulatedinSection1,itshallbedeemedthattheCheckedBaggagehasbeendeliveredtothePassengerwithoutlossordamage. 4.IntheeventthatthereisnonotificationorobjectionwithinthetimeperiodstipulatedinSection1andSection2,thePassengermaynotfileasuitagainsttheAirline. ARTICLE41PASSENGER’SLIABILITYTOCARRIER AnyPassenger,whocauseddamagetoCarrierbyhisnegligenceorwillfulmisconduct,orbyhisfailuretocomplywiththeseConditionsofCarriageandtheARTICLESandregulationsestablishedthereunder,shallbeliabletoCarrierforsuchdamages. ARTICLE42TIMELIMITATIONONACTIONS AsforthelawsuitrelatedtotheresponsibilityoftheCarriershallbebroughtwithin2yearsfromthedateofthePassenger’sarrivalatthedestination,thedatetheaircrafthavearrivedorthedateonwhichtheCarriagehasstopped,whicheveristhelatest,regardlessofitsclaimbases,andthePassenger’sthecauseofactionwillbeextinguishedthereafter. 12."NORMALFARE"meansthefullfareestablishedforanormal,regularorusualservice. 13."SPECIALFARE"meansafareotherthanaNormalFare. 17.CHECK-INmeanstheprogressconsistingofseatassignment,issuanceofboardingpass,baggageacceptance,etc,thatisperformedbytheairlinetomakepassengersreadytoboardflights. 18."CHECK-INDEADLINE"meansthetimelimitspecifiedbytheairlinebywhichpassengersmusthavecompletedcheck-informalitiesandreceivedboardingpass. 19."CHILD"means,beforethecommencementoftherespectivetravel,apersonof2yearsofageorabovebutunder12yearsofage. 20."INFANT"means,beforethecommencementoftherespectivetravel,apersonunder2yearsofage. 21."BAGGAGE"meanssucharticles,effectsandotherpersonalpropertyofapassengerasarenecessaryforwearing,use,comfort,orconvenienceinconnectionwithhis/hertrip.Unlessotherwisespecified,Baggageincludesbothcheckedandunchecked(Carry-on)baggageofthepassenger. 22."CHECKEDBAGGAGE"meansbaggageloadedontheaircraftforcarriageofwhichcarriertakescustodyandforwhichcarrierhasissuedabaggageclaimtag. 23."UNCHEKCEDBAGGAGE",whichisequivalenttohandluggage,meansbaggagethatisallowedtobecarriedontheaircraft. 24."BAGGAGETAGFORCHECKEDBAGGAGE"meansadocumentissuedbycarrierforidentificationandcarriageofthecheckedbaggage. 25."ROUNDTRIP",whichisequivalenttoareturnjourney,meanstravelfromonepointtoanotherandreturnbythesameairrouteusedoutboundwhetherornotthefaresoutboundandinboundbethesame.Travelling,fromonepointtoanotherandreturnbydifferentairroutefromwhichwasusedforinbound,alsoisdefinedasroundtripaslongasoutboundandinboundareunderthesamefare.26."CONJUNCTIONTICKET"meanstwoormoreticketsconcurrentlyissuedtoapassengerandwhichconstituteasinglecontractofcarriage. 26."OPEN-JAWTRIP"meanstravelwhichisessentiallyofaroundtripnaturebuttheoutwardpointofdepartureandinwardpointofarrivaland/oroutwardpointofarrivalandinwardpointofdepartureofwhicharenotthesame. 27."DAMAGE"includesdeath,injury,delay,loss,orotherdamageofwhatsoevernaturearisingoutoforinconnectionwiththecarriageorotherservicesperformedbycarrierincidentalthereto. 28."INDIRECTDAMAGE"meanspassenger’scostsorothercostssupportedbyevidencearisingoutoforinconnectionwithloss,damage,anddelayeddeliveryofbaggage. 29."SDR"meansaSpecialDrawingRightasdefinedbytheInternationalMonetaryFund. ARTICLE2APPLICATIONOFCONDITIONS 1. General NothingintheseConditionsofCarriageandotherapplicableTariffsmodifiesorwavesanyprovisionoftheConvention. 2. Applicability TotheextentnotinconflictwiththeConventionandexceptasexcludedbyEastarJetarJetinrelationtoCarriagewhollyonitsowndomesticservices,theseConditionsofCarriageshallapplytoallCarriageofPassengersandBaggageincludingallservicesincidentalthereto,performedbyEastarJetatfares,rates,andchargespublishedinconnectionwiththeseConditionsofCarriage. 3. GratuitousCarriage WithrespectGratuitousCarriage,EastarJetreservestherighttoexcludetheapplicationofalloranypartoftheseConditionsofCarriage,providedthatanysuchexclusionshallbeconsistentwithallapplicablelaws,governmentregulations,andorders(includingtheConvention). 4. CharterAgreement CarriageofPassengersandBaggageperformedpursuanttoacharteragreementwithEastarJetshallbepreferablysubjecttosuchcharteragreement,andanyothersnotspecificallyprovidedinthecharteragreementshallbesubjecttotheseConditionsofCarriage.ThePassenger,byacceptingCarriagepursuanttoacharteragreementandaCarriageisperformedthereunder,shallberegardedashavingagreedtosaidagreementandtheseConditionsofCarriage,whetherornothe/shehasconcludedthecharteragreementwithEastarJet. 5.Effectiveness AllCarriageofPassengersand/orBaggageshallbesubjecttotheseConditionsofCarriageandotherapplicableTariffsineffectonthedateofreservationoftheTicket. 6.AmendmentwithoutNotice TheseConditionsofCarriageandrulesandregulationsestablishedthereundermaybeamendedwithoutnoticeifitisinevitablyrequiredtodosoasotherwisespecifiedunderthelaw,relevantacts,government,order,orserviceimprovement.However,amendmentaftercommencementofajourneyshallnotbeapplicabletothecarriageagreementconcernedandsuchamendmentshallbenotifiedinadvancedthroughpostingonhomepageorothersmethods. 7.CodeShare 1)Onsomeservices,EastarJethasarrangementswithothercarriersknownas“CodeShares”.ThismeansthatevenifPassengershaveareservationwithEastarJetandholdaTicketwhereEastarJet’snameorairlinedesignatorcodeisindicatedasthecarrier,anothercarriermayoperatetheaircraft.Ifsucharrangementisapplied,EastarJetwilladvisePassengersoftheCarrieroperatingtheaircraft. 2)FortheCarriageofPassengerand/orBaggagethroughCodeShare,theseConditionsofCarriagewillbeapplied. 3)However,notwithstandingwiththeforegoingsection,EastarJetCodeSharepartnermayapplyitsConditionsofCarriageasanactualoperatingairlineforthefollowingcases: a.Check-intimelimitsandprocedures; b.CarriageofPassengerwithspecialneeds; c.FreeBaggageallowanceandexcessBaggagecharge; d.SpecialBaggage,Carriageofanimalsanditscharge;and e.Provisionofcateringserviceanditscategories; ARTICLE3TICKET 1.GeneralTerms TicketshallnotbeissuedandEastarJetshallnottransportthePassengerinanycaseuntilthePassengerhaspaidtheapplicablefareorhascompliedwiththecreditarrangementestablishedbyEastarJet. 2.TicketValidityforCarriageanditsExpiry 1) TicketshallbevalidfortheCarriagefromtheairportofdeparturetotheairportofarrivalviatherouteindicatedintheTicketandfortheCarriagewithregardstothebookingclass.Andshallbevalidwithintheperiodspecifiedin‘2)’below. 2) UnlessspecifiedseparatelyintheTicket,thevalidityoftheTicketshallbe1yearfromthecommencementdateofCarriageandincaseofallunusedTicket,itshallbe1yearfromtheissuancedate.ThebookingclassontheTicketandthebookingclassinthePassengerNameRecord(PNR)mustconform.Incasetheabovementionedbookingclassdiffers,theboardingofthePassengerconcernedmayberejectedandtheboardingmaybepermittedoncethedifferenceinamountstatedissettled. 3.ExtensionofTicketValidity 1).ThevalidityofTicketsshallbeextendedbyEastarJetwithoutadditionalcollectionoffareinthefollowingcases.(But,bookingchangefeemaybechargedaccordingtoacasebasedonfareconditions). a.Fornolongerthan30daysbeyondtheoriginallimit,whenEastarJet: (1)cancelsorpostponestheflightduringtheperiodofvalidity; (2)omitsascheduledstopwhichisthepassenger’splaceofdeparture,placeofdestinationorplaceofstopover; (3)failstooperateaflightreasonablyaccordingtoschedule; (4)causesthepassengertomissaconnection(Thedifferencesoffareorendorsementchargesforotherconnectionflightshallnotbepaid.); (5)substitutesadifferentclassofservices;or (6)isunabletoprovidepreviouslyconfirmedspaces. 2)UnlessotherwiseprovidedintheapplicableTariffs,whenaPassengerispreventedfromtravelingwithintheperiodofvalidityofhisTicketduetoillnessesotherthanpregnancy,EastarJetshallextendtheperiodofvalidityofsuchPassengerllTickettothedatewhenhe/shebecomesfittotravelaccordingtoamedicalcertificate,oruntilthefirstserviceoftheclassofEastarJet,forwhichthefarehasbeenpaid,onwhichaseatisavailableafterthepointwherethejourneyisresumedorfromthelastconnectingpoint.EvenifaPassengerprovidesamedicalcertificate,he/sheshallneedtopaythedifferencesoffare. 3)WhenaPassengerpassesawayenroute,thevalidityoftheTicketsoftheaccompanyingimmediatefamilyorotherpersonsaccompanyingthePassengermaybeextendedbynotmorethan45daysafterthedateofdeath. 4)Whenaticketissoldataspecialfarecontainingminimum-stayrequirements,theminimum-stayrequirementwillbewaivedonpresentationofadeathcertificateoracopythereofforpassengerswhoare; a.membersoftheimmediatefamilyofapassengerwhodiesenroute,or b.otherpersonsactuallyaccompanyingapassengerwhodiesenroute. 4.Non-transferability 1) ATicketshallbevalidforthenamedpersononlyandnon-transferable. 2) EastarJetshallnotbeliabletothepersonentitledtobetransportedortothepersonentitledtoreceivesuchrefundforhonoringorrefundingsuchticketwhenpresentedbysomeoneotherthanthepersonentitledtobetransportedthereunderortoarefundinconnectiontherewith.Ifaticketisinfactusedbyanypersonotherthanthepersontowhomitwasissued,withorwithouttheknowledgeandconsentofthepersontowhomitwasissued,EastarJetwillnotbeliablefordeathorinjuryofsuchunauthorizedpersonorfortheloss,destruction,damage,ordelayofsuchunauthorizedperson’sbaggageorotherpersonalpropertyarisingfromorinconnectionwithsuchunauthorizeduse. ARTICLE4STOPOVER Unlessprohibitedduetogovernmentrequest,therestriction,prohibitionoradditionalStopoverchargesstipulatedintheairlineTariffshallbeapplicableandshallbeindicatedintheTicketbasedonagreementwiththeCarrierinadvance. ARTICLE5FARESANDCHARGES 1.ApplicableFaresandCharges 1)UnlessotherwiseagreedinthisGeneralConditionsofCarriageoranapplicableTariff,theapplicablefareandTariff,whichareforthejourneydatedandspecifiedontheTicket,areconsideredaslegallynotifiedbyEastarJetandeffectiveatthetimeofbooking 2)OtherthanthosespecifiedseparatelyintheapplicableTariff,chargeappliesbothwaysandshallbeappliedtothenotifiedroutewithregardstothecharges. 3)Intheeventofavoluntarychangetotheoriginatingflight,thefaresandchargesforthepassenger’sjourneyshallberecalculatedinaccordancewithfaresandchargesineffectondateonwhichthechangeismadeandisreflectedontheTicket. 4)ExceptasotherwiseprovidedintheapplicableTariff,thedirectfarespublishedintheTarifftakeprecedenceoveranycombinationofintermediatefaresapplicabletothesameclassofservicebetweenthesamepoints 5)ExceptasotherwiseprovidedintheapplicableTariff,thefarespublishedintheTariffentitlethePassengertooccupyoneseatoftheapplicableclass. 2.CalculationofUnpublishedFares Whenthefarebetweenanytwopointsisnotspeciallypublished,suchfareshallbecomputedasprovidedintheapplicableTariff. 3.PaymentofFaresandCharges Subjecttothecurrencyexchangelaws,governmentregulations,andacceptabilitytoEastarJet,thepaymentoffaresandchargesmaybemadeinacurrencyotherthanthecurrencyinwhichthefaresorchargesispublished. 1)ApplicableExchangeRate TherateofexchangeestablishedbyEastarJetshallbeusedtoconvertthepublishedfareorchargeintothesellingcurrencyunlessotherwiseprovidedintheapplicableTariff. 2)PaymentsinCurrencyOtherthanKoreanWon Exceptasotherwiseprovidedbythelaws,orders,requirements,and/orregulationsofthegovernment,theexchangeratefortheconversionofthepublishedfareand/orchargesintoanothercurrencyamountshallbethecustomerbuyingrateofbankonMonday.TherateshallbeusedfromTuesdayofthatweektoMondayofthefollowingweek. Ticketshallbevalidwhentheflightwithreservedseatandrelevantbookingrecordsconformtotheairline’sbookingsystem.Passengerholdinganunusedopen-dateTicketorcoupon,orwhowishedtochangeticketedreservationtoanotherreservation,shallnotbeentitledtoanypreferentialrightsinregardstoobtainingreservations. 2.ConditionsofReservations 1)AreservationofaseatwithregardstoaspecificflightshallbevalidwhenthepaymentiscompletedandtherecordofconfirmedreservationisreflectedwithinthereservationsystemofEastarJet.WheneverapassengerfailstopurchaseaticketforthereservedspacebythetimefixedbyEastarJet,EastarJetwillcancelthereservationsatanytimewithoutnotice. 2)EastarJetdoesnotguaranteeallocationofanyparticularseatintheaircraft. 3.ReconfirmationofReservations 1)ThereservationsofOpen-jawTripTicketsorroundtripTicketsmaybesubjecttotherequirementtoreconfirmthereservationwithinaspecifiedtimelimit.EastarJetwilladvisePassengerswhenEastarJetrequiresreconfirmation,aswellashowandwherethisreconfirmationshouldbedone.IfaPassengerisrequiredtoreconfirmyetfailstodoso,EastarJetmaycancelhis/herreservationsofOpen-jawTicketsorroundtripTickets.IfaPassenger,however,informsEastarJetthathe/shestillwishestotravelandthereisaseatontheflight,thenEastarJetshallreinstatehis/herreservationandtransporthim/her.Iftherearenoseatsontheflight,thenEastarJetshallmakeareasonableefforttotransportaPassengerstohis/hernextorfinaldestination. 2)PassengersshouldcheckthereconfirmationrequirementsofanyotherCarriersinvolvedinhis/herjourneywiththem.Whenitisrequired,PassengersshouldreconfirmwiththeCarrierwhosecodeappearsfortheflightontheTicket. 4.CommunicationCharges ThepassengerwillbechargedforanycommunicationchargepaidorincurredbyEastarJetfortelephone,telegraph,radioorcablearisingfromaspecialrequestofthepassengerconcerningareservation. 5.CancellationofReservations Incaseofno-showwithoutpriornotificationwithregardstoaconfirmedreservationofaflightthataPassengerhasmade,EastarJetmaycancelthereservationofthepassenger’sone-wayorreturnorcontinuousflight.Inaddition,evenifthePassengernotifiesthecancellationinadvance,EastarJetmaycancelthereservationofthecontinuousflight. 6.PersonalInformation APassengerorhis/heragentshouldfurnishEastarJetwiththePassenger'srequiredpersonalinformation(name,telephonenumber,address,creditcardnumber,etc.)forrequestingaflightreservationoranyotherservicesthatmayormaynotbeprovidedthroughEastarJet.EastarJetmaysharethePassenger'spersonalinformationwithanyofitsownoffices/branches,itsagents,othercarriers,otheraffiliatedcompanies,andtheprovidersofservicestoprovidetherequestedservicesorproducts.ThePassenger'spersonalinformationmayalsobeprovidedtotherelatedgovernmentauthoritiesorotheragenciestocomplywithalllaws,regulations,orders,anddemandsofcountriestobeflownfrom,to,orover. ARTICLE7CHECK-IN&BOARDING 1.Check-In(Seatallocationandcheck-inBaggage) 1)PassengerhastocompletetheseatallocationandBaggagecheck-ininsufficienttimenolaterthanthetimedesignatedbyEastarJetsothatthenecessaryprocedure(securitycheck,immigrationinspectionandothers)canbecompletedbeforethedepartureoftheflight. 2)ThedesignatedtimemaydifferdependingontheairportcircumstanceperairportandPassengermustbeawareofthesaidtimeandbeontime. 3)IncasethePassengerdoesnotcompletetheallocationofseatandBaggagecheck-inwithinthedesignatedtime,EastarJethastherighttocancelthereservationofthePassengerconcernedwithoutnotification.TheboardingtimeofEastarJetisindicatedinthewebsiteandcanbecheckedwithEastarJetorrepresentative. 2.Boarding 1)PassengersmustbepresentattheboardinggatenolaterthanthetimedesignatedbyEastarJet. 2)IncasethePassengerisunabletoarriveattheboardinggatebeforethedesignatedtime,EastarJetcanrejecttheCarriageofthePassengerconcernedandcancelthedesignatedseatorseatofreturntrip. 3.Liability EastarJetshallnotbeliabletoPassengersforanylossorexpensesincurredfromtheirfailuretocomplywiththeprovisionsofthisarticle. ARTICLE8REFUSALANDLIMITATIONOFCARRIAGE,ETC 1.RightstoRefuseCarriage 1)EastarJetmayrefusetocarryPassengerorhis/herBaggagewithinreasonableexerciseofitsdiscretionifithasnotifiedthePassengerinwritingthatitwouldnotatanytimeafterthedateofsuchnoticecarrythisPassengeronitsflights. 2)EastarJetwillrefusecarriageordeplaneenroutePassengerandhisorherbaggage,ifoneormoreofthefollowinghaveoccurredoritreasonablybelievesmayoccur: a.ThePassengerhasfailedtofollowtheinstructionsorrequirementsbytherelevantgovernmentauthorityorEastarJetwithrespecttosafetyorsecurity; b.Suchrefusalordisembarkingisnecessarytocomplywithanyapplicablegovernmentlaws,regulations,ororders; c.TheCarriageofPassengerorBaggagemayendangeroraffectthesafety,health,orcomfortofotherPassengersorcrew; d.ThementalorphysicalstateofthePassenger,includingimpairmentfromalcoholordrugs,presentsahazardorrisktohimself,otherPassengers,crew,orproperty; e.ThePassengerhascommittedmisconductsuchasobstructingsafeoperationorcausingdiscomfortorinconveniencetootherpassengersonapreviousflight,andthereisapossibilitythatsuchmisconductmayberepeated; f.ThePassengerhasrefusedtoshowhis/heridentificationuponrequestbyEastarJetoritsdesignatedagenttoconfirmthathe/sheisthepersonnamedontheticket,orhe/shefailstoidentifybyhim/herself; g.ThePassengerhasrefusedtosubmittoasecuritycheckforhisorherpersonorproperty;. h.ThePassengerseekstoenteracountrythroughwhichhemaybeintransitorforwhichhedoesnothavevalidtraveldocument,hasdestroyed,altered,orcounterfeiteddocumentation,orhasrefusedtoprovidetraveldocumentstobeheldbyEastarJetinexchangeforareceipt; i.ThePassengerpresentsaTicketthathasbeenunlawfullyacquired,hasbeenpurchasedfromanentityotherthanEastarJetoritsauthorizedagent,hasbeenreportedasbeinglostorstolen,oriscounterfeit; j.Apersonengagesinthreateningact,aggressiveactorinsultsduringcheck-inorboarding,creatingconcernsforendangeringthesafetyofotherpassengersandthesafeoperationoftheaircraft. 3)Incasetheallowablecabinloaddropsinevitablyduetocausesbeyondthecontrolunforeseeablebytheairlineinadvance,theairlinemaydesignateminimumPassengersorgoodstosatisfytherevisedallowablecabinload. 4)Incasetheallowablecabinloadisinsufficientduetoexcessivesalesandthenegligenceoftheairline,theairlinemayvoluntarilyencouragePassengerstopostponeboarding.Despitetheeffortsmadebytheairlinetominimizenon-voluntarypostponementofboarding,incasenon-voluntarypostponementofboardinghasoccurredastherearePassengerswillingtopostponeboarding,thePassengerssubjecttoboardingpostponementshallbedesignatedintheorderofunnecessaryairlineemployee,PassengerswithunconfirmedreservationandPassengerswithconfirmedreservation.However,insuchacase,vulnerableusersoftransportationsuchasPassengersaccompaniedbyinfant,disabledandpregnantwomenshallnotbedesignated.Passengerswhoseboardinghasbeenpostponednon-voluntarilyshallbecompensatedpursuanttotheapplicableregulationsandinternationaltreaties. 5)EastarJetwillmakerefundfortheunusedportion(s)ofticketinaccordancewiththeprovisionsinArticle13.3.herein,forthepassengerwhoisrefusedcarriageordisembarkedenrouteforoneofthereasonsinsubparagraphs"1)"through"4)"above. 2.ConditionalAcceptanceofCarriage 1)EastarJetshallcarry,subjecttotheapplicableTariffsandtherelatedregulations,Passengerswhosestatus,age,ormentalorphysicalconditionmayinvolveanyhazardorrisktohimself/herselfontheconditionthatitshallnotbeliableforanyinjury,illness,disability,anyaggravation,orconsequences(includingdeath)causedbysuchstatus,age,ormentalorphysicalcondition 2)Carriageofunaccompaniedchild,disabled,pregnantwoman,patientorPassengerswhorequirespecialassistancecanonlyberegisteredincasetheinformationrequestedbytheairlinehasbeenprovidedandtheairlinemayrejecttheCarriagethathasbeenproceededwithoutearlyprovisionofinformation. 3)ThePassengershallcontacttheairportbranch,reservationservicecenteratthepointofpurchasingtheTicketandnotifythedisability,pregnancy,illnessandothersthenrequestforthenecessaryitemsandtheairlinemaydeterminetheCarriagepossibilitythroughtheinformationprovidedinadvancebythePassengersuchasdisabled,pregnantwomen,patientandothers.IncasethePassengerrequestsforservicethatcannotbeprovidedduetorestrictionintheairline’sequipment,facilityandothers,theCarriagemayberejected. 4)ThetypesofPassengersthathavetoprovideinformationinadvanceduetoCarriageofPassengerthatrequiresspecialassistancefromtheairlineareasbelow. a.Disabilityinexternalphysicalfunction:Visualdisability,hearingdisability,physicaldisability,brainlesion b.Disabilityininternalorgan:Kidneydisorder,heartlesion,liverdisorder,respiratorydisorder,epilepticdisorder c.Mentaldisorder:Intellectualdisability,autisticdisorder,mentaldisorder,behavioralemotionaldisorder d.Otherhealthdisability 5)WithregardstoDamagessuchasaircraft,injuryanddeathofotherPassengersoroneselfarisingfromnotnotifyingthedisabilityofthePassengerandspecialrequestsrequiredforCarriagetotheairlineinadvance,EastarJetshallbeindemnifiedorresponsibilitymaybemitigatedinaccordancewithArticle14ifithasbeenprovedthattheairlinedidnotcontributetotheDamage. 3.CodeofConductinCabin 1)IfPassengerisinvolvedinanyofthefollowingonboard,thenEastarJetmaytakesuchmeasuresasitdeemsnecessarytopreventthecontinuationofsuchconduct,includingrestraint.SuchPassengersmaybedisembarkedandrefusedonwardCarriageatanypoint,andmaybeprosecutedforoffencescommittedwhileonboardtheaircraft. a.Commotionsuchasverbalabuse,loudsingingandothers b.Incaseofrejectingthecabincrew’slegitimateinstructionordemandwithregardstoallactionsonboard(includingbutnotrestrictedtosmoking,drinking,druguseandcommotion) c,Actinducingsexualhumiliation d.Actofattemptingtoenterthecockpitwithoutthecaptain’sapproval e.Actofhinderingtheworkofthecabincrewthroughdeceptionorforce f.Actofcausingdangertotheaircraft,Passengersonboardortheassetonboard g.Incaseofcausinganxiety,discomfort,damageorinjuryinotherPassengersorcabincrew h.Actofusingelectronicdevicesbyviolatingthe[AviationAct]Article61Clause2 i.Incasethecabincrewdeterminesanacttohinderthesafeoperationoftheaircraftequivalenttosuch 2)ThePassengershallbeliableforanyDamagesorlossincurredasresultsofanyoftheconductdescribedinClause1)above 4.ElectronicDevices Forsafetyreasons,EastarJetmayforbidorlimitoperationaboardtheaircraftofelectronicequipment,including,butnotlimitedto,cellularphones,portabletelevisions,laptopcomputers,portablerecorders,portableradios,CDplayers,electronicgamesortransmittingdevicesincludingradiocontrolledtoysandwalkie-talkies. ARTICLE9BAGGAGE 1.GeneralTerms CarriageofBaggageshallbepursuanttotheConditionsofCarriagevalidatthedayofthecommencementoftravelindicatedintheTicketandotherapplicableTariffs.However,incasethereisaseparateregulationofthecountryconcerned,theregulationofthecountryconcernedshallprevail. 2.CheckedBaggage 1)TheseConditionsofCarriagedonotentitlePassengerstohavetheirbaggagecheckedonjourneysforwhichEastarJetdoesnotofferfacilitiesforcheckingofBaggage. 2)IncaseEastarJetreceivestheCheckedBaggage,thenumberofCheckedBaggageandweightshallbereflectedinthereservationofthecustomerconcernedinthecomputersystem(whichmeansissuingareceiptforCheckedBaggage);Inaddition,EastarJetwillissueaTagforeachpieceofCheckedBaggage. 3)AllCheckedBaggagemustbeproperlypackedinasuitcaseorsimilarcontainertoensuresafeCarriagewithordinarycareinhandling.Fragileorperishablearticles,money,jewelry,silverware,negotiablepapers,securitiesorothervaluables,samples,orbusinessdocumentscouldnotbeinCheckedBaggageorshallnotbeacceptedasCheckedBaggage. 4)IncasePassengerrequestsforcheckingofBaggageafterthepermittedtimeforBaggagecheck-in,EastarJetmayrejectit. 5)EastarJetreservestherighttorefusetheloadingortransportofanybaggageinwhichitsownerisnotthenamelistedontheticketorboardingpassorthatisconsignedtopassengerby3rdparty,. 6)EastarJetshallnotbeliableforallDamagesarisingfromtheconsignmentoftheBaggageofothersandreservestherighttoclaimalllossesandexpensesresultingfromsaidbaggage.7)Checked-inbaggagewillbecarriedinthesameaircraftasthepassengerunlesssuchcarriageisimpracticableduetosafety,security,space,orotherreasons,inwhicheventEastarJetwillmovethebaggageonthenextprecedingorsubsequentflightonwhichspaceisavailable. 3.InspectionofBaggage EastarJetmayinspectthecontentoftheBaggageunderthepresenceofthePassengerifnecessaryduetosafetyandsecurityreasonsandtheexerciseofsuchrightshallnotbedeemedasanintentionoragreementthatEastarJetwouldcarrythecontentsthathavebeenrejectedforCarriageinaccordancewiththisConditionsofCarriageandallregulations. 4.DeliveryofBaggage 1) TheCheckedBaggageshallbedeliveredtothepersonwiththeBaggagetagconcernedimmediatelyoncethebaggagetagissuedbytheairlineisreturnedtoEastarJetinaccordancewiththeCarriageagreement.EastarJetshallnotbeobligedtocheckwhetherthepersonwiththebaggagetagistherightholderforreceivingtheBaggageandshallnotberesponsibleinanywaywhatsoeverwithregardstothelossdamageorexpensesarisingdirectlyorindirectlyfromnotcheckingit. 2) IftheprovisionsofSubparagraph1)abovearenotcompliedwithbyapersonclaimingthebaggage,EastarJetwilldeliverthebaggageonlyonconditionthatsuchpersonestablishedtoEastarJet’ssatisfactionhisorherrightstheretoand,ifrequiredbyEastarJet,suchpersonshallfurnishadequatesecuritytoindemnifyEastarJetforanyloss,damageorexpensewhichmaybeincurredbyEastarJetasaresultofsuchdelivery. 3) Incasethepersonwiththebaggagetagmakesarequest,theCheckedBaggagemaybedeliveredatthedepartingplaceorstop-overplaceunderthesameconditionsasstipulatedinSubparagraph1)aboveaslongasitispermittedwithoutviolatingtheregulationofthegovernment.Insuchacase,EastarJetshallnotberesponsibleforrefundofchargepaidfortheCarriageoftheBaggageconcerned. 4) Acceptanceofbaggagebythebearerofthebaggageclaimtagwithoutwrittencomplaintatthetimeofdeliveryispresumptiveevidencethatthebaggagehasbeendeliveredingoodconditionandinaccordancewiththecontractofcarriage. 5.RestrictedItems If,intheopinionofEastarJet,theweight,sizeorcharacterofbaggagerendersitunsuitableforcarriageontheaircraft,EastarJet,priortooratanystageofthejourney,willrefusetocarrythebaggageoranyportionthereof. 1) HazardousitemsstipulatedinICAO(InternationalCivilAviationOrganization)andIATA(InternationalAirTransportAssociation) 2) Itemsthatmaycausedangertotheaircraftorlifeandproperty 3) Prohibitedgoodsinaccordancewiththeregulationsandordersofthecountryofdeparture,stopover,arrival 4) ItemswithconcernforDamageduringCarriageorpackagedinappropriately 5) Restricteditemsinaccordancewiththeregulationonsafety 6) Liveanimals 7) WheelchairusedbythedisabledpersonalshallbecarriedasCheckedBaggage.(However,theCarriageofelectricwheelchairshallbedeterminedpursuanttotheregulationofIATA’shazardousgoodsdependingonthebatterytype.) 8) RestricteditemsforCheckedBaggage(High-endpersonalelectronicproductssuchaslaptop,computer,mobilephone,camcorder,camera,MP3andothers,money,jewelry,sample,document,easilydamagedgoods,perishablegoodsandothers.)(Asforlithiumbattery,CarriageispermittedinsmallquantityacknowledgedtobeforpurposeofpersonaluseofguestduringthejourneyinaccordancewiththeIATA’sregulationonhazardousgoods.) EastarJetshallnotberesponsibleinanywaywhatsoeverwithregardstoDamage,lossordelayindeliverythatoccursduringCarriagewithregardstotheabovementioneditems. 6.FreeBaggageAllowanceforPassenger FreecheckedBaggageanduncheckedBaggageallowanceshallbesubjecttoGeneralConditionsofCarriageForInternationalPassengersandBaggageofEastarJet.WithoutprioragreementbetweenPassengerandEastarJet,checkedBaggagewhosesumofthreedimensionsexceeds203centimetersorwhoseweightexceeds32kilogramsmayberefusedcarriage. 7.UncheckedBaggage(Carry-onItems) 1) Passengermaycarryone(1)baggagesuitableforplacinginclosedoverheadrackorunderpassengerseat,withmaximumthreedimensionsofnotmorethan115cm(Length55cm,width40cm,height20cm),atnocostontheconditionthatthePassengerwouldfullyberesponsibleforcarryingandstorageonboard. 2) ThearticleslistedbelowmaybecarriedfreeofchargeinthecabinbyPassengersinadditiontothecarry-onitemsintheaboveSubparagraph1). a.Anovercoat,blanket,orwrap b.Bookstoreadincabin c.Babyfoodforconsumptioninflight d.Afullycollapsiblewheelchair,apairofcrutches,braces,prostheticdevices,andotherequipmentforPassengerswithdisabilities 3) RegardlessoftheprovisionsinSubparagraph1)above,PassengermaycarryonboardtheaircraftBaggageofsuchbulkyorfragilenatureastorequireblockingoutoruseofaseatorseats,subjecttoamaximumweightof75kgs(165pounds)perseat;providedthattheweightofsuchbaggagesocarriedshallnotbeincludedondeterminingthepassenger’sfreeBaggageallowancenorhisorherexcessbaggagecharges.TheapplicablechargeforsuchBaggagecarriedperseatwillbetheregularfarethatwouldhavebeenchargedtoanadultpassengeroccupyingtheseatfortheapplicablejourneyatthetimeofbookingtheadditionalseat. 4) BaggageviolatingSubparagraph1orexceedingtheallowanceofUncheckedBaggageshallbecarriedasCheckedBaggage(GateBag)andchargedperbagbyexcessbaggagechargepolicyofEastarJet. 8.ExcessBaggageCharges 1)OtherthanspecifiedintheapplicableTariff,withregardstoBaggageexceedingthefreeBaggageallowancestipulatedinParagraph6above,aseparatechargeforexcessiveBaggageshallbeimposedinaccordancewiththeapplicableTariffvalidonthedayofissuingtheexcessiveBaggagetag. 2)AtthePassenger’soption,excessBaggagechargesshallbepayableeitheratthepointoforiginfortheentirejourneyviastopoverpointstothefinaldestination(eventhoughBaggagemaynotinsomecasesbecheckedthroughtothefinalDestination),oratthepointsoforigintothepointofstopover.Whenthetripisresumedinthelattercase,thechargesshallbepayablefromthepointofStopovertothenextpointoftheStopoverorDestination.IfPassengerneedstocheckmoreBaggageinadditiontoexcessBaggagealreadycheckedtothefinalDestination,EastarJetshallissueanotherexcessBaggagetagandcollecttheincreasedamountfromthechargealreadypaid 3)IncasethePassengerdoesnotpaythechargeinaccordancewiththepaymentmethodofcredittransactionconditionsstipulatedbyEastarJet,EastarJetshallrejecttheCarriageofBaggage. 4)IncasetherouteofthePassengerischangedoritsCarriageiscancelled,theregulationappliedtotheadditionalpaymentofCarriageorrefundofCarriageshallequallybeapplicabletothepaymentorrefundofexcessiveCarriagecharge. 9.ExcessValueCharges A.EastarJetdoesnotofferexcessvaluechargeservice.EastarJetmayrefusetocarrythePassengerswhorequestthisservice. B.InthecaseofreroutingorcancellationofCarriage,theprovisionswhichgovernwithrespecttothepaymentofadditionalfaresortherefundingoffaresshallalsogovernthepaymentorrefundingofexcessBaggagechargesandexcessvaluecharges.ButnorefundofvaluechargeswillbemadefortheportionofCarriagecompleted. 10.AcceptanceofBaggagebyEastarJet ExceptasotherwiseprovidedintheseConditionsofCarriage,EastarJetshall,uponpresentationofavalidTicketcoveringtransportationoverthelinesofEastarJetoroverthelinesofEastarJetandonemoreotherCarriers,EastarJetwillaceeptBaggagetenderedbythepassengerforCarriageoverthelinesdesignatedontheTicketwithinthetimeprescribedbyEastarJet.EastarJet,however,shallnotacceptBaggageinanyofthefollowingcases. 1)TheBaggageischeckedtobedeliveredtoaplacebeyondtheDestination,orisnotontheroutedesignatedonsuchTicket. 2)TheBaggageischeckedtobedeliveredtoaplacebeyondthenextpointofStopover. 3)TheBaggageischeckedtobedeliveredtoaplacebeyondapointoftransfertoanyotherCarrierwithwhichEastarJethasnotformedaninterlinebaggageagreementorwhichhasdifferentregulationsforCarriageofBaggage. 4)TheBaggageischeckedtobedeliveredtoaplacebeyondapointwhichthePassengerholdsnoreservation. 5)TheBaggageischeckedtobedeliveredtoaplacebeyondapointatwhichthePassengeristotransfertoaconnectingflight,andsuchflightisscheduledtodepartfromadifferentairportthantheonewherethePassengerisscheduledtoarrive. 6)TheBaggageischeckedtobedeliveredtoaplacebeyondapointatwhichthePassengerdesirestoresumepossessionofsuchBaggageoranyportionofit. 7)TheBaggageischeckedtobedeliveredtoaplacebeyondapointwhichallapplicablechargeshavenotbeenpaid. ARTICLE10SCHEDULES,CHANGESANDCANCELLATIONSOFFLIGHTS 1.Schedules 1)Thetimesshowninthetimetablesorelsewhereareapproximateandnotguaranteed,andformnopartofthecontractofCarriage.Schedulesaresubjecttochangewithoutnotice,andEastarJetassumesnoresponsibilityformakingconnections.EastarJetshallnotberesponsibleforerrorsoromissionsinthetimetablesorotherrepresentationsofschedules.Noemployee,agent,orrepresentativeofEastarJetisauthorizedtobindEastarJettoanystatementsorrepresentationsofthedatesortimesfordeparturesandarrivalsoroftheoperationofanyflight. 2)Uponreservation,EastarJetshallnotifyexpectedschedulevalidatthepointofreservationtothePassengeranduponticketing,shallindicateintheTicket.TheexpectedschedulemaybechangedevenaftertheTicketisusedandincasethePassengerhasprovidedthecontactdetailstoEastarJet,suchchangesshallbenotified.However,EastarJetshallnotberesponsiblewithregardstoDamagearisingfromEastarJetnotreceivingnotificationonthechangesduetothePassenger’scircumstancesuchasnotprovidingavalidcontactdetailstotheairline.IntheeventthescheduleischangedafterthepurchaseoftheTicketandthePassengerdoesnotacceptit,andincaseEastarJetwasunabletoreserveareplacementflightthatthePassengercanaccept,itshallberefundedinaccordancewithArticle11.4. 2.ChangesandCancellations 1)EastarJetmaysubstitutealternateCarrieroraircraftwithoutnotice. 2)EastarJetmaywithoutnotice,cancel,terminate,divert,postponeordelayanyflightorthefurtherrightofcarriageorreservationoftrafficaccommodationsanddetermineifanydepartureorlandingshouldbemade,withoutanyliabilityexcepttorefundinaccordancewiththeseConditionsofCarriagethefareandchargesforanyunusedportionoftheticket;WhileEastarJetshallbeliableforfailureordelayofflightscausedasaresultofcarrier’swilfulmisconductornegligence,assetforthintheapplicabletariffs,regulationsandConditionsofCarriageherein. a.becauseofanyfactbeyonditscontrol(including,butwithoutlimitation,meteorologicalconditions,actsofGod,strikes,riots,civilcommotion,embargoes,wars,hostilities,disturbances,orunsettledinternationalconditions),actual,threatenedorreported,orbecauseofanydelay,demand,condition,circumstancesorrequirementdue,directlyorindirectly,tosuchfact;or b.becauseofanyfactnottobeforeseen,anticipatedorpredicted;or c.becauseofanygovernmentregulation,order,demandorrequirement;or d.becauseofshortageoflabor,fuelorfacilities,orlabordifficultiesofEastarJetorothers. 3)EastarJetmaycanceltherightorfurtherrightofcarriageofthepassengerandhisorherbaggageuponrefusalofthepassenger,afterdemandbyEastarJet,topaythefareorportionthereofsodemanded,ortopayanychargesodemandedandassessablewithrespecttothebaggageofthepassenger,withoutbeingsubjecttoanyliabilitythereforeexcepttorefund,inaccordancewiththeseConditionsofCarriage,theunusedportionofthefareandcharge(s)previouslypaid,ifany.. 3.RevisioninRoutings,andFailuretoProvideConnections 1))IntheeventEastarJetcancelsaflight,failtooperateaflightreasonablyaccordingtoschedule,failstostopatapointtowhichthepassengerisdestinedoristicketedtostopover,isunabletoprovidepreviouslyconfirmedspace,orthepassengerisrefusedcarriageorremovedinaccordancewithArticle8.1.EastarJetwilleither; a.carrythepassengerinanotherflightofEastarJetonwhichspaceisavailable, b.endorsetoanothercarrierorothertransportationservicetheunusedportionoftheticketforthepurposeofrerouting, c.reroutethepassengertothedestinationorpointofstopovershownontheticketorapplicableportionthereofbyitsownorothertransportationservices;or d.makeinvoluntaryrefundinaccordancewithArticle11.4. 2)IntheeventPassengermissesanonwardconnectingflightofEastarJetonwhichspacehasbeenreservedforhimbecausethedeliveringcarrierdidnotoperateitsflightaccordingtoschedule,orchangedthescheduleofsuchflight,thedeliveringcarrierwillarrangeforthecarriageofthepassengerormakeotherarrangementsandEastarJetshallnotbeliableforsuchmissedconnection. 3)AninvoluntarilyreroutedPassengershallbeentitledtoretainthefreeBaggageallowanceapplicabletotheclassofserviceoriginallypaidfor. ARTICLE11REFUNDS 1.GeneralTerms RefundsbyEastarJetforanunusedTicketorportionshallbemadeinaccordancewiththefollowingconditions. 1)EastarJetmayrefusearefundwhentheapplicationforrefundismademorethan30daysafterthedeparturedate. 2)Exceptasprovidedbelow,refundswillbemadetothepersonnamedasthepassengerontheTicket. a.RefundofTicketsshallbemadetoacreditcardaccountofthepersontowhomsuchcreditcardhasbeenissued. b.Ifthepurchaserdesignatesthepersonwhomtorefundatthetimeofpurchase,thenrefundshallbemadetothedesignatedperson.Exceptthis,refundshallonlybemadetothepurchaserorthePassenger. 3)Refundsmadeinaccordancetothepersonrepresentinghimselfastheperson,company,ortravelagentnamedordesignatedinthedocumentpresentedforrefundshallbeavalidrefund.EastarJetshallnotbeliableforanotherrefundtoarightfulpersononcetherefundhasbeenmade. 4)EastarJetmayrefuserefundonaticketwhichhasbeenpresentedtogovernmentofficialsofacountryortoEastarJetasevidenceofintentiontodeparttherefromunlessthepassengerestablishestoEastarJet’ssatisfactionthathehaspermissiontoremaininthecountryorthathewilldeparttherefrombyanothercarrierorconveyance. 2.Currency Allrefundshallbesubjecttogovernmentlaws,rules,regulations,orordersofthecountryinwhichtheTicketwasoriginallypurchasedandofthecountryinwhichtherefundisbeingmade.Subjecttotheforegoingprovisions,refundsshallbemadeinthecurrencyinwhichthefarewaspaid,thelegalcurrencyofKorea,thecurrencyofthecountrywheretherefundismade,orinthecurrencyofthecountryinwhichtheTicketwaspurchased,inanamountequivalenttotheamountdueinthecurrencyinwhichthefareswereoriginallycollected.However,whenrequestedtorefundinKorea,therefundshallbebasicallymadeinKoreanWon,thelegalcurrencyofKorea. 3.VoluntaryRefund 1)"VoluntaryRefund"statedinthisclausemeanstherefundofTicketotherthan”InvoluntaryRefund”asspecifiedinParagraph4below 2)Theamountofavoluntaryrefundshallbeasfollows a.Whennoportionofthetriphasbeenmade,theamountofrefundshallbetheamountoffarepaidminusanyapplicableservicechargesorcancellationfees. b.Whenaportionofthetriphasbeenmade,theamountofrefundshallbethedifferencebetweenthefullamountoffarepaidandtheamountoffareandchargesappliedforthefinishedlegofjourney.Anyapplicableservicechargesorcancellationfeesshallbedeductedfromthisamountofrefund. 3)WhentherefundingofanyportionofTicketwouldresultinsuchTickethavingbeenusedbetweenpointswhereCarriageoftrafficisprohibitedtoEastarJet,anysuchrefundwillbedeterminedinaccordancewithSubparagraph2).2.aboveasifsuchTickethadbeenusedtoapointbeyond,towhichcarriageoftrafficisnotprohibited. 4.InvoluntaryRefund 1)Forthepurposeofthisarticle,theterm“InvoluntaryRefund”meansanyrefundmadebecausethePassengerispreventedfromusingtheCarriageprovidedinhisTicketbecauseofflightcancellation,inabilityofEastarJettoprovidethepreviouslyconfirmedseat,substitutionofadifferenttypeofequipmentorclassofservicebyEastarJet,missedconnections,postponementordelayofflight,omissionofscheduledstop,orrefusaltocarryundertheconditionsprescribedinArticle8.1. 2)TheamountofrefundforcausesattributabletoEastarJetshallbecalculatedasfollows. a.Whennoportionofthetriphasbeenmade,theamountofrefundshallbetheamountoffarepaid. b.Whenaportionofthetriphasbeenmade,therefundamountshallbetheamountcomputedaccordingtooneofthefollowing. (1)Anamountequaltotheone-wayfare(oronroundtriporcircuittripTickets,one-halfoftheroundtripfare)andchargesapplicabletotheunusedtransportationfromthepointofterminationtotheDestinationorStopoverpointnamedontheTicketortothepointatwhichtransportationistoberesumed.Ifanydiscountswereappliedintheoriginalfare,thenthesediscountsarealsoappliedintherefund. (2)Thedifferencebetweentheamountoffarepaidandtheamountoffareusedforthetransportation. ARTICLE12GROUNDTRANSPORTATIONSERVICES ExceptasotherwisespecifiedinapplicableTariffs,EastarJetdoesnotmaintain,operate,orprovidegroundtransferservicewithinairportsorbetweenairportanddowntown.ExceptwheregroundtransferserviceisdirectlyoperatedbyEastarJet,itisagreedthatanysuchserviceisperformedbyindependentoperatorswhoarenotandshallnotbedeemedtobeagentsoremployeesofEastarJet.Anythingdonebyanemployee,agent,orrepresentativeofEastarJetinassistingthePassengertomakearrangementsforsuchgroundtransferserviceshallinnowaymakeEastarJetliablefortheactsoromissionsoftheseindependentoperators.IncaseswhereEastarJetmaintainsandoperatessuchgroundtransferservicesforPassengers,theterms,conditions,rulesandregulationsofEastarJet,including(butwithoutlimitation)thosestatedorreferredtointheirTickets,baggagechecks,andbaggagevaluationagreementsshallbedeemedapplicabletothesegroundtransferservices.Noportionofthefareshallberefundableifgroundtransferservicesarenotused. ARTICLE13TAXES,FEES,CHARGES,ETC. Applicabletaxes,fees,andchargesimposedbygovernmentorbytheoperatorofanairportcollectiblefromPassengershallbechargedinadditiontothepublishedfaresandcharges.Theservicecharges,fees,andothercollectiblechargesduetochangesinanycircumstancesimposedbyEastarJetwilllbealsocollectedinadditiontothepublishedfaresandcharges.Ifanewtax,fee,orchargeisimposedafterticketissuance,thenPassengerswillbeobligedtopayit. ARTICLE14ADMINISTRATIVEFORMALITIES 1.ComplianceofRegulations ThePassengerhastocomplywiththeactsofthecountryofdeparture,StopoverorDestination,regulations,orders,requirements,travelconditionsandregulationsandinstructionsofEastarJet.EastarJetshallnotberesponsiblewithregardstotheadviceorguidanceprovidedverballyorinwritingtothePassengerbytheemployeeoragentofEastarJetinrelationtotheacquisitionofrequireddocumentsinformedverbally,inwritingorothermethodsorinrelationtothecomplianceoftheconcernedacts,regulations,orders,requirementsorinstructions.Inaddition,EastarJetshallnotberesponsibleinanywaywhatsoeverwithregardstotheresultoccurredinthePassengerfromnon-acquisitionofdocumentsconcernedornon-compliancewiththeconcernedacts,regulations,orders,requirements,conditionsorinstructions. 2.PassportsandVisas 1)Thepassengermustpresentallexit,entryandotherdocumentsrequiredbylaws,regulations,orders,demandsorrequirementsofthecountriesconcerned.EastarJetwillrefusecarriagetoanypassengerwhohasnotcompliedwithapplicablelaws,regulations,orders,demandsorrequirements,orwhosedocumentsarenotcomplete.EastarJetisnotliabletothepassengerforlossorexpenseduetothepassenger’sfailuretocomplywiththisprovision,andifdamageiscausedtoEastarJetbecauseofpassenger’sfailuretocomplywiththisprovision,thepassengershallindemnifyEastarJettherefor. 2)Subjecttoapplicablelawsandregulations,thepassengeragreestopaytheapplicablefarewheneverEastarJet,ongovernmentorder,isrequiredtoreturnPassengertohisorherpointoforiginorelsewhereduetothepassenger’sinadmissibilityintoacountry,whetheroftransitorofdestination.EastarJetwillapplytothepaymentofsuchfaresanyfundspaidbythepassengertoEastarJetforunusedcarriage,oranyfundsofthepassengerinthepossessionofEastarJet.ThefarecollectedforcarriagetothepointofrefusalordeportationwillnotberefundedbyEastarJet. 3.CustomsInspection Ifrequired,thepassengermustattendinspectionofhisorherbaggage,checked-inorunchecked-in,bycustomsorothergovernmentofficials.EasterJetacceptsnoresponsibilitytowardthepassengerifthelatterfailstoobservethiscondition.IfdamageiscausedtoEasterJetbecauseofthepassenger’sfailuretoobservethiscondition,thepassengershallindemnifyEasterJettherefor. 4.GovernmentRegulations EastarJetcannotbeheldliableifitingoodfaithreasonablydeterminesthatwhatitunderstandstobeapplicablelaw,governmentregulation,demand,order,orrequirementresultsinEastarJetrefusingtocarryPassenger. ARTICLE15LIABILITYOFCARRIERS 1.Successive(Connective)Carriers CarriagetobeperformedunderoneTicketorunderaTicketandanyconjunctionTicketissuedinconnectionwithseveralsuccessiveCarriersisregardedasasingleoperation. Insuchacase,theliabilitywithregardstoDamagethathasoccurredinrelationtothejourneyofthePassengerineachsectorshallbedeterminedinaccordancewiththeConditionsofCarriageoftherelevantsector’sCarrierandshallnotbeliablewithregardstothesectoroperatedbyotherCarriers. 2.ApplicableLaws 1)AsforInternationalCarriageinthisConditionsofCarriage,theregulationsrelatedtotheresponsibilitiesandrestrictionsstipulatedintheWarsawConventionorWarsawConventionasamendedattheHague,1955orMontrealConvention. 2)TotheextentnotinconflictwiththeprovisionsofSubparagraph1)above,allCarriageandotherservicesperformedbyEastarJetaresubjecttothefollowing. a.a.applicablelaws(includingnationallawsimplementingtheConventionorextendingtherulesoftheConventiontocarriagewhichisnot“internationalcarriage”asdefinedintheConvention),governmentregulations,ordersandrequirements. b.theseConditionsofCarriageandapplicabletariffs,regulationsandtimetables(butnotthetimesofdepartureandarrivalthereinspecified),whichmaybeinspectedatanyofitsofficesandinanyairportfromwhichitoperatesregularservices.3)Carrier’snamemaybeabbreviatedintheticketandcarrier’saddressshallbetheairportofdepartureshownoppositethefirstabbreviationofcarrier’snameintheticket;andforthepurposeoftheConvention,theagreedstoppingplacesarethoseplaces,excepttheplaceofdepartureandtheplaceofdestination,setforthintheticketandanyconjunctionticketissuedtherewithorshownincarrier’stimetablesasscheduledstoppingplacesonthepassenger’sroute.Alistgivingthefullname,anditsabbreviationofeachcarrierissetforthinapplicabletariffs. 3.LimitationofLiabilityandReservationofRightsofRecourse EastarJetissubjecttothefollowing,unlessotherwisespecifiedbytheConventionorotherapplicablelaws. 1)Generalterms a.EasterJetisnotliableforanydeath,injury,delay,lossorclaimofwhatsoevernature(hereinafterinthisConditionsofCarriagecollectivelyreferredtoas“damage”)arisingoutoforinconnectionwithcarriageorotherservicesperformedbyEasterJetincidentalthereto,unlesssuchdamageisprovedtohavebeencausedbythenegligenceorwillfulfaultofEasterJetandtherehasbeennocontributorynegligenceofthepassenger. b.EastarJetisnotliableforanyDamagedirectlyandindirectlyarisingoutofcompliancewiththelawsorwithgovernmentregulations,orders,orrequirements,orfromfailureofthePassengertocomplywithsame,oroutofanycausebeyondEastarJet’scontrol c.EastarJetshallnotbeliableinanyeventforanyconsequentialorspecialDamagearisingfromCarriagesubjecttotheseConditionsofCarriageandapplicableTariffs,whetherornotEastarJethadknowledgethatsuchdamagemightbeincurred.d.AnyexclusionorlimitationofliabilityofEastarJetundertheseConditionsofCarriageandapplicableTariffsshallapplytoEastarJet’sagents,employees,andrepresentativesactingwithinthescopeoftheiremploymentandalsotoanypersonwhoseaircraftisusedbyEastarJetforCarriageaswellashisagent,employees,andrepresentativesactingwithinthescopeoftheiremployment. 2)PhysicalDamagesuchasPassenger’sdeath,injuryandothersClaimsmadebyPassengerofEastarJetoramemberoftheirfamilies,notbyathirdpartyorarepresentative,withrespecttoCarriageperformedbyEastarJetshallbehandledasfollows: a.EasterJetshallnotinvokethelimitationofliabilityinArticle22(1)oftheWarsawConventionasamendedattheHague,1955astoanyclaimforrecoverablecompensatorydamagesarisingunderArticle17oftheWarsawConventionasamendedattheHague,1955. b.EasterJetshallnotavailitselfofanydefenseunderArticle20(1)oftheWarsawConventionasamendedattheHague,1955withrespecttothatportionofsuchclaimwhichdoesnotexceed128,821SDRs. c.ExceptasotherwiseprovidedinParagraphsa.andb.hereof,EasterJetreservesalldefensesavailableundertheConventiontoanysuchclaim.EasterJetalsoreservesallrightsofrecourseagainstanyotherperson,includingwithoutlimitation,rightsofcontributionandindemnity. d.NotwithstandingtheregulationsofSubparagrapha.andItemb.above,EastarJetmayexerciseallrightsasaCarrierstipulatedintheconventionandotheractswithregardstoclaimforcompensationforDamagefiledbythepersonwhohascausedthePassenger’sdeath,injuryandotherphysicalinjuriesduetocausingintentionalDamage,onbehalfofthesaidpersonorinrelationtotheperson. e.TheclaimsforDamagesraisedbypublicsocialinsuranceorsimilarbodiesexceptforanysuchbodiesoftheUnitedStates(U.S.SocialAgencies)shallbesubjecttothelimitinArticle20(1)andtodefensesunderArticle22(1)oftheWarsawConventionasamended. f.ThesummentionedintermsofSDRinSubparagraphb.aboveshallmeantheSpecialDrawingRightsasdefinedbytheInternationalMonetaryFund.Convensionofthesumintonationalcurrenciesshall,incaseofjudicialproceedings,bemadeaccordingtotheexchangerateofsuchcurrenciesapplicableonthedateoffinaljudgementbythecourt,or,incaseofotherthanjudicialproceedings,accordingtotheexchangerateofsuchcurrenciesapplicableonthedatewhenthedamagestobepaidisagreedupon. 3)DamageofBaggage a.EastarJet,unlessEastarJethasintentionallyorbynegligence,shallnotberesponsiblefortheDamageofUncheckedBaggageinanycasewhatsoever.AssistancerenderedtothepassengerbyEasterJet’semployeesinloading,unloadingortransshippinguncheckedbaggageshallbeconsideredasgratuitousservicetothepassenger. b.AnyliabilityofEastarJetfordelay,Damage,orlostbaggageisasfollows. (1)AnyliabilityofEasterJetexceptb.belowislimitedto250FrenchGoldFrancsoritsequivalent(theUnitedStatesequivalentisapproximatelyUSD20)perkilograminthecaseofchecked-inbaggage,and5,000FrenchGoldFrancsoritsequivalent(theUnitedStatesequivalentisapproximatelyUSD400)perpassengerincaseofunchecked-inbaggageorotherproperty.Intheeventofdeliverytothepassengerofpartbutnotallofhisorherchecked-inbaggage,orintheeventofdamageofpartbutnotallofsuchbaggage,theliabilityofEasterJetwithrespecttotheundeliveredordamagedportionshallbereducedproportionatelyonthebasisofweight,notwithstandingthevalueofanypartoftheBaggageorcontentsthereof. (2)TheliabilityofEastarJetis1,288SDRsperPassengerforcheckedandhand-carryBaggagewheretheMontrealConventionappliestothePassenger’sJourney.InthecaseofUncheckedBaggage,includingpersonalitems,theCarrierisliableonlyiftheDamageresultsfromitsownfaultorthatofitsemployeesoragents. (3)WhenahighervalueisdeclaredinadvanceandadditionalchargesarepaidpursuanttotheapplicableTariffs,theliabilityofEastarJetshallbelimitedtothishigherdeclaredvalue.Underanycircumstances,EasterJet’sliabilitywillnotexceedtheactuallosssufferedbythepassenger.Allclaimsaresubjecttoproofofamountofloss. c.EastarJetisnotliableforDamagetoPassenger’sBaggagecausedbythepropertycontainedinthePassenger’sBaggage.AnyPassengerwhosepropertycausedDamagetoanotherPassenger’sBaggageorthepropertyofEastarJetshallindemnifyEastarJetforalllosesandexpensesincurredbyEastarJetasaresultthereof. d.EasterJetisnotliableforloss,damageto,ordelayinthedeliveryoffragileorperishablearticles,money,jewelry,silverware,negotiablepapers,securitiesorothervaluables,businessdocumentsorsampleswhichareincludedinthepassenger’schecked-inbaggage,whetherwithorwithouttheknowledgeofEasterJet e.EasterJetmayrefusetoacceptanyarticleswhichdonotconstitutebaggageassuchitemisdefinedherein,butifdeliveredtoandreceivedbyEasterJet,sucharticleshallbedeemedtobewithinthebaggagevaluationandlimitofliability,andshallbesubjecttothepublishedratesandchargesofEasterJet. f.WhenEasterJetissuesaticketorchecksbaggageforcarriageoverthelinesofanothercarrier,EasterJetdoessoonlyasagentofsuchcarrierexceptwithrespecttocodeshareflights.EasterJetshallnotbeliableforthedeath,injuryordelayofPassengerortheloss,damageordelayofunchecked-inbaggage,notoccurringonitsownline;andEasterJetshallnotbeliablefortheloss,damage,ordelayofchecked-inbaggagenotoccurringonitsownline,exceptthatthepassengershallhavearightofactionforsuchloss,damageordelayonthetermshereinprovidedagainstEasterJet,whenEasterJetisthefirstcarrierorthelastcarrierundertheagreement. tocarry. 4.Delayinschedule TheresponsibilityofEastarJetwithregardstothedelayofPassengershallnotexceedthelimitstipulatedintheConventioninanycase. 4.ReasonsforClaimsorActions AnyactionforDamagesthatoccurredduringtheCarriageofPassengerandBaggage,whetherincontract,intort,orotherwise,canonlybebroughtsubjecttotheconditionsandlimitssetoutintheConvention.TheConventionshallnotaffectindeterminingthepersonshavetherighttobringsuitandwhataretheirrespectiverights. ARTICLE16TIMELIMITATIONSONCLAIMSANDACTIONS 1.TimeLimitationonClaimsforDamages NoactioncanbetakeninregardstoBaggageDamageunlessthepersonentitledtodeliveryclaimstoanofficeofEastarJetafterthediscoveryofDamageatthelatestwithin7daysfromthedateofreceipt.Inthecaseofdelayorloss,theclaimsmustbemadeatthelatestwithin21daysfromthedateonwhichtheBaggagehasbeenplacedathis/herdisposal(inthecaseofdelay),orshouldhavebeenplacedathis/herdisposal(inthecaseofloss).Everyclaimmustbeinwritinganddispatchedwithinthetimespecifiedabove.IncasetheCarriageisnot“internationalCarriage”asdefinedinthe“Convention”,litigationmaybefiledevenifthereisnonotificationofobjectionconcernedontheconditionthatthepersonfilingforcompensationforDamageprovesthefollowingitems. 1)Itwasreasonablynotpossibletogivesuchnotice 2)ItwasimpossibletomakethenoticeconcernedduetodeceptionofEastarJet. 3)EastarJetwasawareofDamagetoPassenger’sBaggage 2.TimeLimitationonActions AllclaimsorrightstodamagesagainstEasterJetshallbeextinguishedunlessanactionisbroughtwithinaperiodof2yearsreckonedfromthedateofarrivalatthedestination,orfromthedateonwhichtheaircraftoughttohavearrived,orfromthedateonwhichthecarriagestopped.
