PixelPassTermsofServiceLastUpdated:October19,2021IntroductionPixelPassisaserviceprovidedbyGoogleLLC(“Google”,“we,”or“us”),locatedat1600AmphitheatreParkway,MountainView,California94043,USA,andissubjecttothetermsbelow,andthefollowingPixelPassTermsofServiceareadditionaltermswhichapplytoyouruseofPixelPass.YouagreethatyouruseofPixelPassissubjecttothesePixelPassTermsofServiceand:GoogleStoreSalesTermsGoogleOneTermsofServiceGooglePlayTermsofServiceYouTubePaidServiceTermsofServiceGoogleTermsofServiceTogether,forpurposesofthesePixelPassTermsofService,werefertothemasthe“Terms”.PixelPassiscomprisedof“Device”asdefinedintheGoogleStoreSalesTerms(“GStoreSalesTerms”)anda“Service”asdefinedintheGoogleTermsofService(“GoogleToS”).UseofYouTubePremium,GoogleOne,orGooglePlayPassaresubjecttotheindividualtermsprovidedabove.Anydeviceprotectiontermswillbesubjecttothethirdparty’stermsforPreferredCareorDeviceProtectionuponsigningup.YouruseofadditionalGoogleproductsorservicesisgovernedbythetermsofserviceapplicabletosuchproductsorservices.Note:theGooglePrivacyPolicydescribeshowdataishandledinthisservice.IfthereisanyconflictbetweenthePixelPassTermsofServiceandtheindividualtermslistedabove,thePixelPassTermsofServicewillprevail.IfthereisanyconflictbetweentheEnglishlanguageversionoftheTermsandaversiontranslatedintoanotherlanguage,theEnglishlanguagetextwillprevail.PleasereadtheTermscarefully.GeneralDescriptionofPixelPassPixelPassisamembershipprogramthatincludes:(1)aGooglePixelphone,(2)selectservicesfromGoogle,includingGooglePlayPass,GoogleOne,andYouTubePremium(“Googleservices”),and(3)PreferredCare.PixelPassismadeavailablebyGoogletoprovideyouwithadestinationforGoogleservicesandsupport,providespecialoffers,anddiscovernewfeaturesandproducts.PaymentandSubscriptionInordertopurchasePixelPassthroughtheGoogleStore,youwillneedaGooglePaymentsaccount,andmustaccepttheGooglePaymentsTermsofServiceandacknowledgetheGooglePaymentsPrivacyNotice.Subscriptions.PixelPassisautomaticallychargedeachbillingperiodfor24monthsuntilyoucancelitandwillbesubjecttothePixelPassCancellationPolicyinSection[5]below.GoogleStoreFinancing.YouwillneedtocreateanduseaGoogleStoreFinancingaccountthroughSynchronyinordertopurchasePixelPassontheGoogleStore.TheGoogleStoreFinancingcreditcardisissuedbySynchronyBank.DecisionsaboutGoogleStoreFinancing,issuance,andmanagementoftheGoogleStoreFinancingcreditcardaresolelymadebySynchronyBankandnotGoogle.Youmustabidebyanyrelevanttermsandconditionsorotherlegalagreement,whetherwithGoogleorathirdparty,thatgovernsyouruseoftheGoogleStoreFinancingaccount.YouaresolelyresponsibleforallamountspayableassociatedwithpurchasesyoumakethroughyourGoogleStoreFinancingaccount.Formoreinformation,pleasereviewtherelevanttermsandconditions.WhenpurchasingthroughtheGoogleStore,themonthlysubscriptionpriceforPixelPass(whichisabundledprice,asshownonthecheckoutpage)willappearastwoseparatetransactionsonyourSynchronystatement—onechargewillbeforthePixelphoneandPreferredCare(includinganyapplicabletaxesandshippingfees),andonechargewillbefortheGoogleservices(includinganyapplicabletaxes)partofPixelPass.ForthePixelphoneandPreferredCareportionofthemonthlyprice,GooglewillchargeyouforthepurchasepriceofthePixelphoneandPreferredCareatthetimeofpurchase,whichyouwillrepayinmonthlyinstallmentstoSynchrony.FortheGoogleservicesportionofthemonthlyprice,GooglewillchargeyouamonthlysubscriptionpricefortheGoogleservicesincludedinPixelPass,toberepaidtoSynchronyonamonthlybasis.ChangesWemaychangethePixelPassineffectbutwillgiveyoupriornoticeofthesechanges.Thesechangeswillapplyafteryourcurrentpaymentperiodiscompleted,whenthenextpaymentisduefromyouafterthenotice.Wewillgiveyouatleast30days’priornoticeofapriceincreasebeforeyouarecharged;ifyouaregivenlessthan30days'priornotice,thechangewillnotapplyuntilthepaymentafterthenextpaymentisdue.IfyoudonotwishtocontinuewithPixelPassorthenewprice,youmaycancelatanytimeaccordingtothePixelPassCancellationPolicy.Yourcancellationwillapplytothenextbillingperiodafterthecurrentserviceterm.However,therearetimeswhenwewillneedtomakechangestoPixelPasswithoutgivingnotice.ThesewillbelimitedtoinstanceswhereweneedtotakeactiontoensurethesecurityandoperabilityofPixelPass,preventabuse,orwherewemustacttomeetlegalrequirements.CancellationandTerminationYoumaycancelyourPixelPassmembershipatanytimebyvisitingyoursubscriptionmanagementpageonGoogleStore.Ifyoucancelyoursubscription,youwillretainyourPixeldevice,butbesubjecttothePixelPassCancellationPolicy.YouraccesstoGoogleservicesprovidedthroughPixelPasswillalsobeterminatedandsubjecttothePixelPassCancellationPolicy.YourPreferredCareservicewillalsobeterminatedaccordingtothePreferredCaretermsandconditions.DeviceCost.YouwillpayadiscountedpriceforthePixelphoneover24months.Ifyoucancelyourserviceorsubscriptionanytimebeforetheendofthe24months,yourGoogleStoreFinancingaccountwillbechargedaone-timepriceadjustment,whichisproratedbasedonthediscountyoureceivedbygettingyourphoneaspartofyourPixelPasssubscriptionandhowlongyou’vebeensubscribed.GoogleServices.YouagreethatyoumayloseaccesstoYouTubePremium,GooglePlayPass,andGoogleOneservicesandfunctionality,withoutrefundattheendofthecurrentbillingcycle.PreferredCare.YourPreferredCareservicewillalsobeterminatedaccordingtothePreferredCaretermsandconditions.BreachofTerms.IfyoubreachthesePixelPassterms,GooglemaystopprovidingPixelPasstoyouatanytime.YouwillnotbeeligibleforarefundandwilloweSynchronyfortheoutstandingbalanceofyourdevice.PixelPassProgram.GooglereservestherighttosuspendorterminatePixelPassatanytime,uponreasonablenoticetoyou.ToimprovePixelPass,Googlemaychangeitsbillingplatformwithoutnoticetoyou.SubscribingataLaterTime.Ifyoursubscriptioniscancelledandyoulaterdecidetore-subscribewithanewPixelphone,youwillbechargedatthethencurrentsubscriptionrate.ServiceAnnouncementsInconnectionwithyouruseofPixelPass,wemaysendyouserviceannouncements,administrativemessages,andotherinformation.Wemayalsosendyouemailsanddevicenotificationsassociatedwithyourmemberbenefits.Youmayoptoutofsomeofthosecommunications.PromotionsOtheroffersforYouTubePremium,GoogleOne,andPlayPasscannotbecombinedwithPixelPass.
