OnJune18,1971,TheWashingtonPostbeganpublishingitsownseries.BenBagdikian,aPosteditor,hadobtainedportionsofthepapersfromEllsberg.ThatdaythePostreceivedacallfromWilliamRehnquist,anassistantU.S.AttorneyGeneralfortheOfficeofLegalCounsel,askingthemtostoppublishing.WhenthePostrefused,theU.S.JusticeDepartmentsoughtanotherinjunction.TheU.S.Districtcourtjudgerefused,andthegovernmentappealed. OnJune26,1971,theU.S.SupremeCourtagreedtotakebothcases,mergingthemintoNewYorkTimesCo.v.UnitedStates.[52]OnJune30,1971,theSupremeCourtheldina6–3decisionthattheinjunctionswereunconstitutionalpriorrestraintsandthatthegovernmenthadnotmettheburdenofproofrequired.Thejusticeswrotenineseparateopinions,disagreeingonsignificantsubstantiveissues.WhileitwasgenerallyseenasavictoryforthosewhoclaimtheFirstAmendmentenshrinesanabsoluterighttofreespeech,manyfeltitalukewarmvictory,offeringlittleprotectionforfuturepublisherswhenclaimsofnationalsecuritywereatstake.[50] InSeptember2008,TheNewYorkTimesannouncedthatitwouldbecombiningcertainsectionseffectiveOctober6,2008,ineditionsprintedintheNewYorkmetropolitanarea.[62]ThechangesfoldedtheMetroSectionintothemainInternational/NationalnewssectionandcombinedSportsandBusiness(exceptSaturdaythroughMonday,whileSportscontinuestobeprintedasastandalonesection).ThischangealsoincludedhavingtheMetrosectioncalledNewYorkoutsideoftheTri-StateArea.ThepressesusedbyTheNewYorkTimescanallowfoursectionstobeprintedsimultaneously;asthepaperincludesmorethanfoursectionsonalldaysexceptforSaturday,thesectionswererequiredtobeprintedseparatelyinanearlypressrunandcollatedtogether.ThechangesallowedTheNewYorkTimestoprintinfoursectionsMondaythroughWednesday,inadditiontoSaturday.TheNewYorkTimes'announcementstatedthatthenumberofnewspagesandemployeepositionswouldremainunchanged,withthepaperrealizingcostsavingsbycuttingovertimeexpenses.[14] Becauseofitsdecliningsaleslargelyattributedtotheriseofonlinenewssources,favoredespeciallybyyoungerreaders,andthedeclineofadvertisingrevenue,thenewspaperhadbeengoingthroughadownsizingforseveralyears,offeringbuyoutstoworkersandcuttingexpenses,[64]incommonwithageneraltrendamongprintnewsmedia.Followingindustrytrends,itsweekdaycirculationhadfallenin2009tofewerthanonemillion.[65] In2016,reportersforthenewspaperwerereportedlythetargetofcybersecuritybreaches.TheFederalBureauofInvestigationwasreportedlyinvestigatingtheattacks.Thecybersecuritybreacheshavebeendescribedaspossiblybeingrelatedtocyberattacksthattargetedotherinstitutions,suchastheDemocraticNationalCommittee.[70]
