Ruling373.Ifinghuslanypartoftheouterareaofthebodyisleftunwashed,theghuslisinvalid.However,washinginsidetheears,nose,andwhateverisconsideredtobeaninnerpartofthebodyisnotobligatory. Ruling374.Ifapersondoubtswhetherapartofthebodyisconsideredtobeanouterorinnerpart,hemustwashit. Ruling375.Ifearingholesandsuchlikehavebecomesostretchedthattheirinnerareasareconsideredtobeouterpartsofthebody,thenthoseareasmustbewashed;otherwise,itisnotnecessarytowashthem. Ruling376.Anythingthatisanobstacleforwatertoreachthebodymustberemoved;ifoneperformsghuslbeforebecomingconfidentthattheobstaclehasbeenremoved,theghuslisinvalid. Ruling377.Ifwhileperformingghuslonerationallydeemsitprobablethatthereissomethingonhisbodythatmaybeanobstacleforwatertoreachthebody,hemustexamineitandbecomeconfidentthatitisnotanobstacle. Ruling378.Inghusl,shorthairthatisconsideredpartofthebodymustbewashed.Itisnotobligatorytowashlonghair.Infact,ifonemakeswaterreachtheskininawaythatthehairdoesnotbecomewet,theghuslisvalid.However,ifitisnotpossibleforwatertoreachtheskinwithoutthehairbecomingwet,thenonemustwashthehairinawaythatwaterreachesthebody. Ruling379.Alltheconditionsthatwerementionedforwuḍūʾtobevalid–suchasthewaterbeingpureandnotbeingusurped–arealsoconditionsforghusltobevalid.However,inghusl,itisnotnecessaryforthebodytobewashedfromtoptobottom.Furthermore,insequentialghusl,itisnotnecessaryforthebodytobewashedimmediatelyafterwashingtheheadandneck;therefore,thereisnoproblemifafteronehaswashedhisheadandneckhewaitsandaftersometimehewasheshisbody.Infact,itisnotnecessaryfortheentireheadandnecktobewashedinonego;therefore,itispermitted,forexample,foronetowashhisheadandafterawhileforhimtowashhisneck.Furthermore,ifsomeonewhocannotcontrolthedischargeofurineorfaecesdoesnotdischargeurineorfaecesforthelengthoftimethatittakeshimtoperformghuslandprayers,hemustimmediatelyperformghuslandthenhemustimmediatelyperformprayers. Ruling380.Ifsomeonewantstopayoncreditforusingapublicbathwithoutknowingwhetherornottheownerconsents[tothisformofpayment,butstillperformsghuslthere],thenevenifafterwardstheowneraccepts,hisghuslisvoid. Ruling381.Iftheownerofapublicbathconsentsforthemoneyowedtohimforusingthepublicbathtobepaidoncreditbutthepersonwhoperformsghusldoesnotintendtopaythedebtheoweshim,orheintendstopayhimfromunlawfulmoney,hisghuslisvoid. Ruling382.Ifsomeonepaystheownerofapublicbathfrommoneyonwhichtheone-fifthtax(khums)hasnotbeenpaid,thenalthoughhehascommittedanunlawfulact,theapparentrulingisthathisghuslisvalidbutheremainsindebtedtothoseentitled(mustaḥiqqūn)toreceivekhums. Ruling383.Someonewhodoubtswhetherornothehasperformedghuslmustperformit.However,ifafterperformingghuslonedoubtswhetherornothisghuslwasvalid,itisnotnecessaryforhimtoperformghuslagain. Ruling384.Ifwhileoneisperformingghuslhehasaminoroccurrence(al-ḥadathal-aṣghar)(2)–forexample,heurinates–itisnotnecessaryforhimtostopperformingtheghuslandtostartanotherghusl[alloveragain];rather,hecancompletehisghuslbutbasedonobligatoryprecaution,hewillrequirewuḍūʾ[forperformingactsthatrequirewuḍūʾ].However,if[onehasaminoroccurrencewhileperformingasequentialghusland]hechangesfromperformingasequentialghusltoanimmersiveone,or,[ifonehasaminoroccurrencewhileperforminganimmersiveghuslandhechangesfromperforming]animmersiveghusltoasequentialone,itisnotnecessaryforhimtoalsoperformwuḍūʾ. Ruling385.Ifduetoshortageoftimeone’sdutywastoperformtayammumbutthinkingthathehadenoughtimetoperformbothghuslandtheprayer,heperformedghuslinsteadandhisprayersbecameqaḍāʾ[i.e.theywerenotperformedintheirprescribedtime],thenincasehehadperformedghuslwiththeintentionofattainingproximitytoAllah,hisghuslisvalidevenifhehadperformedtheghuslinordertoperformprayers. Ruling386.Ifafterperformingprayersapersonwhohadbecomejunubdoubtswhetherhehadperformedghuslornot,theprayersheperformedarevalid;however,forfutureprayershemustperformghusl.Ifafterprayershehasaminoroccurrence,itisnecessaryforhimtoalsoperformwuḍūʾ;andifthereistime,hemust,basedonobligatoryprecaution,repeattheprayershehadperformed. Ruling387.Someonewhomustperformanumberofobligatoryghuslscanperformoneghuslwiththeintentionofallofthem;andtheapparentrulingisthatifhemakestheintentionofoneparticularghusl,itwillsufficeforotherghusls[andhedoesnothavetomakeseparateintentions]. Ruling388.IfaverseoftheQur’anoranameofAllahtheExaltediswrittenonpartofone’sbody,intheeventthathewantstoperformghuslinitssequentialform,hemustmakewaterreachtheareainawaythathishanddoesnottouchthewriting.ThesameappliesifhewantstoperformwuḍūʾandaverseoftheQur’aniswrittenononeofthepartsofhisbodyonwhichwuḍūʾisperformed;and[incasehewantstoperformwuḍūʾ]andanameofAllahiswritten,thesameapplies,albeitbasedonobligatoryprecaution. Ruling389.Someonewhohasperformedtheghuslforjanābahmustnotperformwuḍūʾforprayers.Hecanperformprayerswithoutperformingwuḍūʾafterotherobligatoryghuslsaswell,exceptghuslformediumistiḥāḍah.Furthermore,[hecanperformprayerswithoutperformingwuḍūʾ]withrecommendedghusls–whichwillbediscussedinRuling633–althoughtherecommendedprecautionisthat[ifhehasperformedarecommendedghusl],heshouldalsoperformwuḍūʾ. (1)AsmentionedinRuling15,aslongaskurrwaterdoesnotacquirethesmell,colour,ortasteofanimpuritywithwhichithascomeintocontact,itdoesnotbecomeimpure. (2)Ḥadath(literally,‘occurrence’)isatermusedinIslamiclawtorefertosomethingthatinvalidateswuḍūʾ;itcanbeoftwotypes:al-ḥadathal-aṣghar(minoroccurrence)andal-ḥadathal-akbar(majoroccurrence).Aminoroccurrenceissomethingthatrequiresonetoperformwuḍūʾinordertoengageinanactofworshipthatrequireswuḍūʾ,suchasprayers.Thesethingsare:urinating,defecating,passingwind,sleeping,thingsthatcauseonetolosehismind(suchasinsanity,intoxication,andunconsciousness),andslightirregularblooddischarge(al-istiḥāḍahal-qalīlah).Asforamajoroccurrence,thisissomethingthatrequiresonetoperformghuslinordertoperformanactofworshipthatrequireswuḍūʾ;underthiscategorycomethefollowing:ritualimpurity(janābah),menstruation(ḥayḍ),lochia(nifās),mediumandexcessiveirregularblooddischarge(al-istiḥāḍahal-mutawassiṭahandal-kathīrah),andtouchingacorpse(massal-mayyit).
