ApplicableTerms YouruseoftheServiceissubjecttotheseterms,theYouTubeCommunityGuidelines andthePolicy,SafetyandCopyrightPolicies (together,the"Agreement").YourAgreementwithuswillalsoincludetheAdvertisingonYouTubePolicies ifyouprovideadvertisingorsponsorshipstotheServiceorincorporatepaidpromotionsinyourContent. AgeRequirements YoumayusetheServiceifyouareatleast13yearsold;however,childrenofallagesmayusetheServiceandYouTubeKids(whereavailable)ifenabledby aparentorlegalguardian. PermissionbyParentorGuardian Ifyouareunder18,youmusthaveyour parentorlegalguardian’spermissiontousetheService.PleasehavethemreadthisAgreementwithyou. YourUseoftheService ContentontheService ThecontentontheServiceincludesvideos,audio(forexamplemusicandothersounds),graphics,photos,text(suchascommentsandscripts),branding(includingtradenames,trademarks,servicemarks,orlogos),interactivefeatures,software,metrics,andothermaterials(collectively,"Content”).ContentmaybeprovidedtotheServiceanddistributed byourusersandYouTubeisaproviderofhostingservicesforsuchContent.ContentistheresponsibilityofthepersonorentitythatprovidesittotheService.IfyouseeanyContentyoubelievedoesnotcomplywiththeseterms,suchasbyviolatingtheCommunityGuidelines orthelaw,youcanreportittous. GoogleAccountsandYouTubeChannels YoucanusepartsoftheService,suchasbrowsingandsearchingforContent, withouthavingaGoogleaccount.However,youdoneedaGoogleaccounttousesomefeatures.WithaGoogleaccount,youmaybeabletolikevideos,subscribetochannels,createyourownYouTubechannel,andmore.YoucanfollowtheseinstructionstocreateaGoogleaccount. Creating aYouTubechannelwillgiveyouaccesstoadditionalfeaturesandfunctions,suchasuploadingvideos,makingcommentsorcreatingplaylists.HerearesomedetailsabouthowtocreateyourownYouTubechannel. ToprotectyourGoogleaccount,keepyourpasswordconfidential.YoushouldnotreuseyourGoogleaccountpasswordonthird-partyapplications.LearnmoreaboutkeepingyourGoogleaccountsecure,includingwhattodoifyoulearnofanyunauthoriseduseofyourpasswordorGoogleaccount. ThefollowingrestrictionsapplytoyouruseoftheService.Youarenotallowedto: access,reproduce,download,distribute,transmit,broadcast,display,sell,license,alter,modifyorotherwiseuseanypartoftheServiceoranyContentexcept:(a)asspecificallypermittedbytheService; (b)withpriorwrittenpermissionfromYouTubeand,ifapplicable,therespectiverightsholders;or(c)aspermittedbyapplicablelaw; circumvent,disable,fraudulentlyengage,orotherwiseinterferewiththeService(orattempttodoanyofthesethings),includingsecurity-relatedfeaturesorfeaturesthat:(a)preventorrestrictthecopyingorotheruseofContent;or(b)limittheuseoftheServiceorContent; accesstheServiceusinganyautomatedmeans(suchasrobots,botnetsorscrapers)except:(a)inthecaseofpublicsearchengines,inaccordancewithYouTube’srobots.txtfile;(b)withYouTube’spriorwrittenpermission; or(c)aspermittedbyapplicablelaw; collectoruseanyinformationthatmightidentifyaperson(forexample,harvestingusernames orfaces),unlesspermittedbythatpersonorallowedundersection3above; usetheServicetodistributeunsolicitedpromotionalorcommercialcontentorotherunwantedormasssolicitations(spam); causeorencourageanyinaccuratemeasurementsofgenuineuserengagementwiththeService,includingbypayingpeopleorprovidingthemwithincentivestoincreaseavideo’sviews,likes,ordislikes,ortoincreaseachannel’ssubscribers,orotherwisemanipulatemetrics; misuseanyreporting,flagging,complaint,dispute,orappealsprocess,includingbymakinggroundless,vexatious,orfrivoloussubmissions; runcontestsonorthroughtheServicethatdonotcomplywithYouTube’scontestpoliciesandguidelines; usetheServiceto vieworlistentoContentotherthanforpersonal,non-commercialuse(forexample,youmaynotpubliclyscreenvideosorstreammusicfromtheService);or usetheServiceto:(a)sellanyadvertising,sponsorships,orpromotionsplacedon,around,orwithintheServiceorContent,otherthanthoseallowedinthe AdvertisingonYouTube policies(suchascompliantproductplacements);or(b)selladvertising,sponsorships,orpromotionsonanypageofanywebsiteorapplicationthatonlycontainsContentfromtheServiceorwhereContentfromtheServiceistheprimarybasisforsuchsales(forexample,sellingadsonawebpagewhereYouTubevideosaretheonlycontentofvalue). Reservation AnyrightnotexpresslygrantedtoyouinthisAgreementremainstherightofYouTubeortherespectiverightsholders.Thismeans,forexample,thatusingtheServicedoesnotgiveyouownershipofanyintellectualpropertyrightsintheContentyouaccess(includinganybrandingusedonordisplayedintheService). Develop,ImproveandUpdatetheService YouTubeisconstantlychangingandimprovingtheService.Aspartofthiscontinualevolution,wemaymakemodificationsorchanges(toallorpartoftheService)suchasaddingorremovingfeaturesandfunctionalities,offeringnewdigitalcontentorservicesordiscontinuingoldones. WemayalsoneedtoalterordiscontinuetheService,oranypartofit,inordertomakeperformanceorsecurityimprovements,makechangestocomplywithlaw,orpreventillegalactivitiesonorabuseofoursystems.Thesechangesmayaffectallusers,someusersorevenanindividualuser.WhentheServicerequiresorincludesdownloadablesoftware(suchastheYouTubeStudioapplication),thatsoftwaremayupdateautomaticallyonyourdeviceonceanewversionorfeatureisavailable,subjecttoyourdevicesettings.Ifwe makematerialchangesthatnegatively impactyour useoftheServiceorifwestopofferinganypartoftheService,we’llprovideyouwithreasonableadvancenotice,exceptinurgentsituationssuchaspreventingabuse,respondingtolegalrequirements,oraddressingsecurityandoperabilityissues.We’llalsoprovideyouwithanopportunitytoexportyourcontentfromyourGoogleAccountusingGoogleTakeout, subjecttoapplicablelawandpolicies.  YourContentandConduct UploadingContent IfyouhaveaYouTubechannel,youmaybeabletouploadContenttotheService.YoumayuseyourContenttopromoteyourbusinessorartisticenterprise.IfyouchoosetouploadContent,youmustnotsubmittotheServiceanyContentthatdoesnotcomplywiththisAgreementorthelaw.Forexample,theContentyousubmitmustnotincludethird-partyintellectualproperty(suchascopyrightedmaterial)unlessyouhavepermissionfromthatpartyorareotherwiselegallyentitledtodoso. YouarelegallyresponsiblefortheContentyousubmittotheService.WemayuseautomatedsystemsthatanalyzeyourContenttohelpdetectinfringementandabuse,suchasspam,malware,andillegalcontent. RightsyouGrant Youretainallofyourownershiprightsin yourContent.Inshort,whatbelongstoyoustaysyours.However,wedorequireyoutograntcertainrightstoYouTubeandotherusersoftheService,asdescribedbelow. LicencetoYouTube ByprovidingContenttotheService,yougranttoYouTubeaworldwide,non-exclusive,royalty-free,transferable,sublicensablelicencetousethatContent(includingtoreproduce,distribute,modify, displayandperformit)forthepurposeof operating,promoting,andimprovingtheService. LicencetoOtherUsers YoualsogranteachotheruseroftheServiceaworldwide,non-exclusive,royalty-freelicencetoaccessyourContentthroughtheService,andtousethatContent(includingtoreproduce,distribute,modify,display,andperformit)onlyasenabledbyafeatureoftheService. DurationofLicence ThelicencesgrantedbyyoucontinueuntiltheContentisremovedasdescribedbelow.Onceremoved,thelicenceswillterminate,exceptwheretheoperationoftheService,useofContentpermittedbeforeyourremoval,orthelawrequiresotherwise. Forexample,removalofContentbyyoudoesnotrequireYouTubeto:(a)recallContentthatisbeingusedbyotheruserswithinanylimitedofflineviewingfunctionalityoftheService;or(b)deletecopieswereasonablyneedtokeepforlegalpurposes. RighttoMonetize YougranttoYouTubetherighttomonetizeyourContentontheService(andsuchmonetizationmayincludedisplayingadsonorwithinContentorchargingusersafeeforaccess).ThisAgreementdoesnotentitleyoutoanypayments.StartingJune1,2021,anypaymentsyoumaybeentitledtoreceivefromYouTubeunderanyotheragreementbetweenyouandYouTube(includingforexamplepaymentsundertheYouTubePartnerProgram,ChannelmembershipsorSuperChat)willbetreatedasroyalties. Ifrequiredbylaw,Googlewillwithholdtaxesfromsuchpayments. Removing YourContent YoumayremoveyourContent fromtheServiceatanytime. YoualsohavetheoptiontomakeacopyofyourContent beforeremovingit.Youmustremoveyour Contentifyounolongerhavetherightsrequiredbytheseterms. RemovalofContentByYouTube IfwereasonablybelievethatanyofyourContent(1)isinbreachofthisAgreementor(2)maycauseharmtoYouTube,ourusers,orthirdparties,wereservetherightto removeortakedownsomeorallofsuchContent.Wewillnotifyyouwiththereasonforouractionunlesswereasonablybelievethattodoso:(a)wouldviolatethelaworthedirectionofalegalenforcementauthority,orwouldotherwiserisklegalliabilityforYouTubeorourAffiliates;(b)wouldcompromiseaninvestigationortheintegrityoroperationoftheService;or(c)wouldcauseharmtoanyuser,otherthirdparty,YouTubeorourAffiliates.Youcanlearnmoreaboutreportingandenforcement,includinghowtoappealontheTroubleshooting pageofourHelpCenter. CommunityGuidelinesStrikes YouTubeoperatesasystemof“strikes”inrespectofContentthatviolatestheYouTubeCommunityGuidelines.EachstrikecomeswithvaryingrestrictionsandmayresultinthepermanentremovalofyourchannelfromYouTube. Afulldescriptionofhowastrikeaffectsyourchannelisavailableonthe CommunityGuidelinesStrikesBasics page.Ifyoubelievethatastrikehasbeenissuedinerror,youmayappealhere. Ifyourchannelhasbeenrestrictedduetoastrike,youmustnotuseanotherchanneltocircumventtheserestrictions.ViolationofthisprohibitionisamaterialbreachofthisAgreementandGooglereservestherighttoterminateyourGoogleaccountoryouraccesstoallorpartoftheService. CopyrightProtection WeprovideinformationtohelpcopyrightholdersmanagetheirintellectualpropertyonlineinourYouTubeCopyrightCenter.IfyoubelieveyourcopyrighthasbeeninfringedontheService,pleasesendusanotice. WerespondtonoticesofallegedcopyrightinfringementaccordingtotheprocessinourYouTubeCopyrightCenter,whereyoucanalsofindinformationabouthowtoresolveacopyrightstrike.YouTube'spoliciesprovideforthetermination,inappropriatecircumstances,ofrepeatinfringers’accesstotheService. AccountSuspensionand Termination TerminationsbyYou YoumaystopusingtheServiceatanytime.Youcanalso deletetheService fromyourGoogleAccount,whichinvolvesclosingyourYouTubechannelandremovingyourdata,with theoptiontodownload acopyofyour data first.  TerminationsandSuspensionsbyYouTube YouTube reservestherighttosuspendorterminateyourGoogleaccountoryouraccesstoallorpartoftheService if:(a)youmateriallyorrepeatedlybreachthisAgreement; (b)wearerequiredtodosotocomplywithalegalrequirementoracourtorder;or(c)wereasonablybelievethattherehasbeenconductthatcreatesliabilityorharmtoanyuser,otherthirdparty,YouTubeorourAffiliates. NoticeforTerminationorSuspension WewillnotifyyouwiththereasonforterminationorsuspensionbyYouTubeunlesswereasonablybelievethattodoso:(a)wouldviolatethelaworthedirectionofalegalenforcementauthority;(b)wouldcompromiseaninvestigation;(c)wouldcompromisetheintegrity, operationorsecurityoftheService;or(d)wouldcauseharmtoanyuser,otherthirdparty,YouTubeorourAffiliates. EffectofAccountSuspensionorTermination IfyourGoogleaccountisterminatedoryouraccesstotheServiceisrestricted,youmaycontinueusingcertainaspectsoftheService(suchasviewingonly)withoutanaccount,andthisAgreementwillcontinuetoapplytosuchuse.Ifyoubelieveyourthattheterminationorsuspensionhasbeenmadeinerror,youcanappealusingthisform. AboutSoftwareinourService DownloadableSoftware WhentheServicerequiresorincludesdownloadablesoftware(suchastheYouTubeStudioapplication),unlessthatsoftwareisgovernedbyadditionaltermswhichprovidealicence,YouTubegivesyouapersonal,worldwide,royalty-free,non-assignableandnon-exclusivelicencetousethesoftwareprovidedtoyoubyYouTubeaspartoftheService.ThislicenceisforthesolepurposeofenablingyoutouseandenjoythebenefitoftheServiceasprovidedbyYouTube,inthemannerpermittedbythisAgreement.Youarenotallowedtocopy,modify,distribute,sell,orleaseanypartofthesoftware,ortoreverse-engineerorattempttoextractthesourcecodeofthatsoftware,unlesslawsprohibittheserestrictionsoryouhaveYouTube’swrittenpermission. OpenSource SomesoftwareusedinourServicemaybeofferedunderanopensourcelicence.Theremaybeprovisionsinanopensourcelicencethatexpresslyoverridesomeoftheseterms. Ifso, wewillmakethatopensourcelicenceavailabletoyou. OtherLegalTerms Warranty WeprovidetheServicewithreasonablecareandskill. Disclaimer Bylaw,consumershavecertainrightsthatcannotbeexcludedoralteredbyacontract.NothinginthisAgreementaffectsthoserightsyoumayhaveasaconsumer.OtherthanasexpresslystatedinthisAgreementorasrequiredbylaw,YouTubedoesnotmakeanyspecificpromisesabouttheService.Forexample,wedon’tmakeanypromisesabout:theContentprovidedthroughtheService; thespecificfeaturesoftheService,oritsaccuracy,reliability,availability,orabilitytomeetyourneeds;orthatanyContentyousubmitwillbeaccessibleorstoredontheService. LimitationofLiability Allusers:NothinginthisAgreementisintendedtoexcludeorlimitanyparty’sliabilityfor:deathorpersonalinjury;fraud;fraudulentmisrepresentation;oranyliabilitythatcannotbeexcludedorlimitedbylaw. Totheextentpermittedbyapplicablelaw,YouTubeanditsAffiliateswillnotberesponsiblefor: lossesthatwerenotcausedbyYouTubeoritsAffiliates’breachofthisAgreement; anylossordamagethatwasnot,atthetimethatthisAgreementwasformedbetweenyouandYouTube,a reasonablyforeseeableconsequenceofYouTubeoritsAffiliatesbreachingthisAgreement;or theContentsubmittedbyany user,orforthedefamatory,offensive,orillegalconductofany user. BusinessUsersonly:IfyouareusingtheServiceforthepurposeofyourtrade,business,craftorprofession,(a“BusinessUser”),totheextentpermittedbyapplicablelaw,thefollowinglimitationsofliabilitywillalsoapply: YouTubeanditsAffiliateswillnotberesponsibleforlostprofits,revenues,ordata;lossofopportunityoranticipatedsavings;indirectorconsequentiallosses,orpunitivedamages(inallcaseswhethersuchlosseswereforeseeableornot);and YouTubeanditsAffiliates’ totalliabilityforanyclaimsarisingfromorrelatingtotheServiceislimitedtothegreaterof:(a)theamountofrevenuethatYouTubehaspaidtoyoufromyouruseoftheServiceinthe12monthsbeforethedateofyournotice,inwritingtoYouTube,oftheclaimand(b)£500,whicheverishigher. Third-PartyLinks TheServicemaycontainlinkstothird-partywebsitesandonlineservicesthatarenotownedorcontrolledbyYouTube.YouTubehasnocontrolover,andassumesnoresponsibilityfor,suchwebsitesandonlineservices.BeawarewhenyouleavetheService;wesuggestyoureadthetermsandprivacypolicyofeachthird-partywebsiteandonlineservicethatyouvisit. AboutthisAgreement Changing thisAgreement WemaychangethisAgreement,forexample,toreflectchangestoourServiceorhowwedobusiness-forexample,whenweaddnewproductsorfeaturesorremoveoldones,(2)forlegal,regulatory,orsecurityreasonsor(3)topreventabuseorharm. IfwemateriallychangethisAgreement,we’llprovideyouwithreasonableadvancenoticeandtheopportunitytoreviewthechanges,except(1)whenwelaunchanewproductorfeature,or(2)inurgentsituations,suchaspreventingongoingabuseorrespondingtolegalrequirements.Ifyoudon’tagreetothenewterms,youshouldremoveanyContentyouuploadedandstopusingtheService. ContinuationofthisAgreement IfyouruseoftheServiceends,thefollowingtermsofthisAgreementwillcontinuetoapplytoyou:“OtherLegalTerms”,“AboutThisAgreement”,andthelicensesgrantedbyyouwillcontinueinlimitedcasesasdescribedunder“DurationofLicense”. Severance IfitturnsoutthataparticulartermofthisAgreementisnotenforceableforanyreason,thiswillnotaffectanyotherterms. Assignment YouTubemaytransferallorpartofthisAgreementtoanAffiliateor,ifYouTubeissold,toathirdparty. NoWaiver IfyoudonotcomplywiththisAgreementandwedonottakeactionimmediately,thisdoesn’tmeanthatwearegivingupanyrightsthatwemayhave(suchastherighttotakeactioninthefuture). GoverningLaw IfyouliveintheUnitedKingdomthisAgreement,andyourrelationshipwithYouTubeunderthisAgreementwillbegovernedbythelawsofyourcountryofresidence,andlegalproceedingsmaybebroughtinyourlocalcourts.
