IbnMaajah(1702)narratedfromAbuHurayrah(mayAllahbepleasedwithhim)thathesaid:No,bytheLordoftheKa‘bah,Ididnotsay,“Whoeverwakesupinastateofjanaabahlethimnotfast”;Muhammad(blessingsandpeaceofAllahbeuponhim)saidit.Thiswasclassedassaheehbyal-AlbaaniinSaheehIbnMaajah. IbnAbiShaybah(2/330)narratedfromIbnal-MusayyibthatAbuHurayrahretractedhisfatwa,“Ifdawncomeswhenapersonisjunub,heshouldnotfast.” Thescholarsareagreedthatweshouldfollowthehadithof‘Aa’ishahandUmmSalamah,notthehadithofAbuHurayrah,withregardtothismatter.ThisissupportedbythefactthatAbuHurayrah(mayAllahbepleasedwithhim)himselfretractedhisfatwainfavouroftheirview. ThereareseveralscholarlyviewsconcerningtheresponsetothehadithofAbuHurayrah. Somesaidthatthehadithof‘Aa’ishahandUmmSalamahoutweighsthehadithofAbuHurayrahbecauseitsisnadismoresound,andbecausethereportoftwotakesprecedenceoverthereportofone. See:Naylal-Awtaar(4/253). Imamal-Bukhaari(mayAllahhavemercyonhim)said,afternarratingthetwohadiths:Thefirstoneismoresoundintermsofitsisnad–referringtothehadithof‘Aa’ishahandUmmSalamah. Endquotefromas-Sunanal-Kubrabyal-Bayhaqi(4/363). SomeofthescholarsinterpretthehadithofAbuHurayrahasmeaningthatthefastinthiscaseistoberegardedasimperfect. IbnKatheersaid: SomeofthescholarsinterpretthehadithofAbuHurayrahasmeaningthatthisfastisimperfect,becauseofthehadithof‘Aa’ishahandUmmSalamahwhichindicatesthatitispermissibletofastinthissituation.Thiswayofinterpretingthetwohadithsisthemostlikelytobecorrectandisthebestwaytoreconcilethereports.AndAllahknowsbest. Whatismeantbythefastbeingimperfectisthatwhatispreferableandmoreperfectfortheonewhowantstofastisthatheshoulddoghuslbeforedawn,sothathewillbeinastateofpurityfromthebeginningoftheday,butifhedelaysdoingghusluntilafterdawn,thatispermissible. Itsaysinal-Mawsoo‘ahal-Fiqhiyyah(28/63): ThehadithofAbuHurayrahistobeunderstoodashavingbeenabrogatedoraspointingtothatwhichispreferable,whichisthatitismustahabbtodoghuslbeforedawn,sothatonewillbeinastateofpurityatthebeginningofthefast.Endquote.
