Eligibility. ThisrouteofcommunicationisopenedonlytoSubscribersofTataPlayorindividualswhohaveapproachedTataPlaythroughtheWhatsappServicebysendingamessageat+919229692296. Period. WhatsappChatServiceshallbeopenforcommunication/interactionfrom25thMay2018onwards.TataPlayreservestherighttoanytimewithdraw,addorvarythismodeofinteraction,orreplaceinwhollythisservice,withoutanypriorinformationtotheSubscriber. Interactivevoiceresponse(‘IVR’): TheSubscribermustcall18002086633,theTataPlayIVRServicefromtheRegisteredMobileNumberoftheSubscriber.SubscribermustcorrectlyfollowtheinstructionsplayedduringtheIVRCall. ShortMessagingServices(‘SMS’): TheSubscribermustSMS WhatsApp to56633fromtheRegisteredMobileNumberoftheSubscriber.  CustomerServiceNumber/HelplineNumbers: TheSubscribermustcall18602086633or18605006633,theTataPlayHelplineNumbersfromtheRegisteredMobileNumberoftheSubscriber.SubscribermustcorrectlyfollowtheinstructionsplayedduringtheCall. ModeofConsentaccessedthroughthecontactnumbersotherthantheRegisteredMobileNumberwillnotberecognizedorconsideredbyTataPlayforactivationoftheWhatsappChatService.UponrecognizingtheRegisteredMobileNumber,TataPlaywillactivatetheWhatsappChatService. Opt-Out: TheSubscriberhastheoptiontoOpt-OutfromcommunicatingwithTataPlaythroughtheWhatsappChatService.ToOpt-Out,theSubscribermaymessage‘STOP’byusingtheWhatsappChatServiceorcalltheCustomerServiceNumber(HelplineNumber)ofTataPlayat18002086633or18605006633,enterhis/herRegisteredMobileNumberandfollowtheinstructionsmentionedonthewebpage. PrivacyPolicy. TataPlaywillusetheinformationprovidedbytheSubscriberinaccordancewiththeTataPlayPrivacyPolicyavailableon www.tataplay.com.InadditiontotheTataPlayPrivacyPolicy,WhatsApp’sPrivacyPolicy(currentlyavailableat https://www.whatsapp.com/legal/#privacy-policy)andthetermsofuseshallbeapplicable.TheabovePrivacyPolicymaybeupdatedfromtimetotimeandwithoutpriorintimationtotheSubscriber. SubscribermustimmediatelyadviseTataPlayofanychangestotheSubscriberInformationshouldanyofthedetailschangetogetherwithanyproofsthatmayberequiredbyTataPlaytosubstantiatethenewinformation.ByprovidinginformationtoTataPlay,theSubscriberacknowledgeandrepresentthatanyInformationprovidedbytheSubscribertoTataPlayisprovidedvoluntarily,isaccurate,up-to-dateandcompleteinallrespectsandthatthatTataPlaymaynotbeabletocomplywithTataPlayobligationsifthecorrectpersonalinformationisnotsuppliedtoTataPlay. Subscribermustnot(orassistothersto)access,use,copy,adapt,modify,preparederivativeworksbasedupon,distribute,license,sublicense,transfer,display,perform,orotherwiseexploitourWhatsappChatServiceinimpermissibleorunauthorizedmanners,orinwaysthatburden,impair,orharmTataPlay,WhatsappChatServiceorWhatsappServices,systems,Whatsappusers,orothers,includingthatSubscribermustnotdirectly,indirectlyorthroughautomatedmeans:(a)reverseengineer,alter,modify,createderivativeworksfrom,decompile,orextractcodefromWhatsappChatServices;(b)gainorattempttogainunauthorizedaccesstotheWhatsappChatServices,orsystems;(c)interferewithordisrupttheintegrityorperformanceoftheWhatsappChatServices;(d)createaccountsforWhatsappChatServicesthroughunauthorizedorautomatedmeans;(e)collecttheinformationoforaboutusersofinanyimpermissibleorunauthorizedmanner. SubscriberagreesandundertakestousetheWhatsappChatServiceonlytopost,sendandreceivemessagesandmaterialthatareproperandrelatedtoTataPlayServices.Inadditiontotheabove,SubscribershallensurethattheWhatsappChatServiceisnotusedforthefollowing: Todefame,abuse,harass,stalk,threatenorotherwiseviolatethelegalrightsofothers. TosendrudemessagesoranyothermessageswhichdoesnotrelatetoTataPlayServices.9.3.3TouploadfilesthatcontainsoftwareorothermaterialprotectedbyintellectualpropertylawsunlesstheSubscriberownsorcontrolstherightstheretoorhavereceivedallnecessaryconsents. Touploadordistributefilesthatcontainviruses,corruptedfiles,oranyothersimilarsoftwareorprogramsthatmaydamagetheoperationoftheWhatsappChatServiceoranother'scomputer. Toadvertiseoroffertosellorbuyanygoodsorservicesforanybusinesspurpose. TodownloadanyfilethattheSubscriberknows,orreasonablyshouldknow,cannotbelegallydistributedinsuchmanner. Falsifyordeleteanyauthorattributions,legalorotherpropernoticesorproprietarydesignationsorlabelsoftheoriginorsourceofsoftwareorothermaterialcontainedinafilethatisuploaded. Violateanycodeofconductorotherguidelines,whichmaybeapplicableforortoanyparticularWhatsappChatServiceormessages. ViolateanyapplicablelawsorregulationsforthetimebeinginforceinoroutsideIndia;andviolateanyofthetermsandconditionsofSubscriptionContractoranyothertermsandconditionsforavailingtheTataPlayServices. TataPlayreservestherighttostoreallinformationoftheSubscriberincludingthemessagesthatarereceivedorsentbytheSubscriberthroughtheWhatsappChatService.ThemannerofstoringtheInformationand/ordataoftheSubscribershallbedecidedbyTataPlay.Theconsentand/ortheinstructiongivenbytheSubscriberthroughtheWhatsappChatServiceshallbeconsideredasconsentand/ordirectionsgivenpersonallybytheSubscriberandTataPlayshallhavetherighttoactuponsuchinstructions.Foravoidanceofdoubt,itisclarifiedthatifathirdpartygivesaconsentand/orinstructionbyimpersonatingastheSubscriber,thenTataPlayshallnotbeheldresponsibleandSubscribershallbesolelyresponsibleforalltheconsentsgiventhroughtheModeofConsentand/ormessagesthatarepostedorsentbytheSubscriberthroughtheWhatsappChatService.TataPlayreservestherighttoterminatetheaccessoftheSubscribertoanyoralloftheWhatsappChatServiceatanytimewithoutnoticeforanyreasonwhatsoever. Inadditiontothetermsandconditionsstatedhere,SubscribersshallbeboundbythetermsandconditionsstipulatedSubscriptionContractand/orandothertermsandconditions,foundonTataPlay'swebsite- www.tataplay.com TataPlaywillnotberesponsibleforanylossordamagecausedtotheSubscribersifthisserviceiscancelledand/orwithdrawnbyTataPlayoriftheSubscriberisnotabletoavailthisserviceduetoaForceMajeureEventincludingwithoutlimitationforreasonsbeyondthereasonablecontrolofTataPlaysuchaswar,naturalcalamities,epidemics,pandemics,floods,failureoftelecommunicationnetwork,satellitetechnologyfailureetc. Subscribersand/oranypersonthroughtheSubscriberswaivesanyandallrightthatsuchanindividualmayhavetoclaimambiguityinthesetermsandconditionsandagreestoreleases,indemnifiesandholdharmlessTataPlayanditsrespectiveaffiliates,advertisingandpromotionagencies,anditsrespectiveagents,partners,representatives,officers,directors,shareholdersandemployeesfromandagainstanyinjuries,losses,damages,claims,actions,oranyliabilityofanykindresultingfromorarisingfromtheuseoftheWhatsappChatService. TataPlayshallnotberesponsibleforprintingortypographicalerrors;orforinstructions,direction,transactionsthatarelost,misdirected,failtoenterintotheprocessingsystem,orareprocessed,reported,ortransmittedlateorincorrectlyorarelostforanyreasonincludingwhatsappsystemorservice,computer,telephone,papertransfer,mailsystem,humanorothererror;orforelectronic,computer,ortelephonicmalfunctionorerror,includinginabilitytoaccesstheWhatsappChatServiceorprocessanytransactionthereon. Anydisputes,differencesorquestions,whichmayariseatanytimehereafterbetweenTataPlayandtheSubscribertouchingthetrueconstructionofthisAgreementorperformanceoftheobligationsorenforcinganyrightsand/orliabilitiesofthePartieshereunder,shallbefirstamicablyresolvedbetweenthePartieswithin30(thirty)daysfromthedateonwhichsuchdisputewasraisedbyaPartyandcommunicatedtotheotherPartyinwritingfailingwhichthedisputeshallbereferredtoasolearbitratoroftheIndianCouncilofArbitration(ICA).ThearbitrationshallbeconductedinaccordancewiththeRulesofArbitrationoftheIndianCouncilofArbitrationandshallbesubjecttotheprovisionsoftheArbitrationandConciliationAct,1996,asamendedoranystatutorymodificationsorre-enactmentthereofforthetimebeinginforce.ThevenueofsucharbitrationshallbeatMumbaiandtheCourtsatMumbaialoneshallhaveexclusivejurisdictiontodealwiththearbitrationproceedingsandtheawardsinaccordancewithlaw.ThearbitrationproceedingsshallbeconductedinEnglishlanguage.TheawardpassedbythearbitratorsshallbefinalandbindingupontheParties.
