motionaldisturbance:911ServicemeansauniversaltelephonenumberwhichgivesthepublicdirectaccesstothePublicSafetyAnsweringPoint(“PSAP”).Basic911servicecollects911callsfromoneormorelocalexchangeswitchesthatserveageographicarea.Thecallsarethensenttothecorrectauthoritydesignatedtoreceivesuchcalls.Clockhourmeanseitherofthefollowing:SupportHoursmeansTelaruswillprovideeffortbetweenthehoursof7:00amand8:00pm,Melbournelocaltime,MondaytoFridayexcludingnationalpublicholidays.Forcedlabororservicesmeanslabororservicesthatareperformedorprovidedbyanotherpersonandareobtainedormaintainedthroughcoercion.LocalLabourmeansskilled,semi-skilledworkersofalltradesengagedbytheContractorontheSiteforthepurposeoforinconnectionwiththeContractorengagedfulltimebytheContractoroffthesiteforthePurposeoforinconnectionwiththeContract(bywayofillustrationbutnotlimitation:workersengagedfulltimeinanyoffice,store,workshoporquarry).Labormeanslaborers,mechanics,andotheremployeesbelowtherankofsupervisor,directlyemployedattheSiteoftheWorksubjecttotheManagerortheirdesignee’sauthoritytodeterminewhatemployeesofanycategoryare“requiredforExtraWork”andastotheportionoftheirtimeallottedtoExtraWork;and“costoflabor”meansthewagesactuallypaidtoandreceivedbysuchemployeesplusaproperproportionof(a)vacationallowancesandunionduesandassessmentswhichtheemployeractuallypayspursuanttocontractualobligationuponthebasisofsuchwages,and(b)taxesactuallypaidbytheemployerpursuanttolawuponthebasisofsuchwagesandworkers’compensationpremiumspaidpursuanttolaw.“Employees”asusedabovemeansonlytheemployeesofoneemployer.Occupationaldiseasemeansadiseasecontractedinthecourseofemployment,whichbyitscausesandthecharacteristicsofitsmanifestationortheconditionoftheemploymentresultsinahazardwhichdistinguishestheemploymentincharacterfromemploymentgenerally,andtheemploymentcreatesariskofcontractingthediseaseingreaterdegreeandinadifferentmannerfromthepublicingeneral.On-PeakHoursmeansHourEnding(“HE”)0800throughHE2300EPT,MondaythroughFriday,excludingSaturday,SundayandPJMholidays.LabourmeansworkeremployedbytheCorporation’scontractordirectlyorindirectlythroughasubcontractororotherpersonsorbyanagentonhisbehalfonapaymentnotexceedingRs.400/-permonthandwillnotincludesupervisorystafflikeOverseersetc.UtilityServicemeansaservice,thetermsandconditionsofwhichareregulatedbytheEUB,andincludesservicesforwhichanindividualrate,jointrate,toll,fare,chargeorscheduleofthem,havebeenapprovedbytheEUB.Diatomaceousearthfiltrationmeansaprocessresultinginsubstantialparticulateremovalinwhichaprecoatcakeofdiatomaceousearthfiltermediaisdepositedonasupportmembrane(septum),andwhilethewaterisfilteredbypassingthroughthecakeontheseptum,additionalfiltermediaknownasbodyfeediscontinuouslyaddedtothefeedwatertomaintainthepermeabilityofthefiltercake.PlannedOutagemeanstheremovalofequipmentfromserviceavailabilityforinspectionand/orgeneraloverhaulofoneormoremajorequipmentgroups.ToqualifyasaPlannedOutage,themaintenance(a)mustactuallybeconductedduringthePlannedOutage,andinSeller’ssolediscretionmustbeofthetypethatisnecessarytoreliablymaintaintheProject,(b)cannotbereasonablyconductedduringProjectoperations,and(c)causesthegenerationleveloftheProjecttobereducedbyatleasttenpercent(10%)oftheContractCapacity.
